(RULES AND PROCEDUR~S FOR TH~ ADMINISTRATTON
OF A MERTT SYSTEM
WHEREAS, Thzs Board has determined that a personnel
rule change is necessita~ed by virtue of the recent decision
of Skelly vs the State personnel Board,
~pW, THERE~ORE BE IT RESOLVED, Personnel Rule Sect~on 8.7
is hereby amended to read as follows:
8.7 NOTICE OF DISCHARGE, DEMOTION OR SUSPENSZON
A department head or desi~nated represen~ative who takes
actzon to discharge, demote or suspend a r~gular or
limited term employee, shall serve the employee a
written notice. The notice shall be served on the
employee personally or by certified mail and sha11
clearly specify the action taken, the reason for the
action including t~e particular facts and specific
incident(s) involved and the e~fective date(s) of the
action. A notice of demotion shall contain a statement
as to the wages and duties of the new position.
Zf the employee has permanent status the notice shall
be served at least (5) five calendar days prior to the
effective da~e of action. The notice shall a~so advise
the employee that a copy of the material upon which the
action is based is a~tached or available for review
upon request during normal business hours; the right
to be represented and to respond verbally or in writing
to the department head or designated representative prior
to the effective date of the action and ~he right to appeal
~_
the action and the time with~n which the appeal may be made.
A department head or a designated ~epresentative taking
discipl~nary action against an employee witih permanent
status may, when it is necessary for the aperation o~
the department, assign the employee to less critical
dut~es during the (5) five calendar day review period.
When extraordinary circumstances exist that requir~ the
zmmediate removal of the employee from the premis~s, a
departiment head or a designated representa~ive may place
the employee on a paid administrative leave subject
to ca11 not to exceed (5) five work days. A copy of all
notices and written responses sha11 be forwarded to ~he
Personnel Director.

County of Butte, State of California, this 2t~h day of
