RESOLUTrON D~CLARING THE PUBLIC WORKS DEPARTMENT THE
OF~YCIAT, AGENCY FOR COORDINATINC MAJOR PUBLZC ~IORKS
PROGRAMS ACCORDING TO GdVERNMENT CODE §65401
WHEREAS, Government Code §65401 requires that each county
officer, department, board or commission and each governmental body,
commission, or board including the governing body o~ any such
district or school district whose ,~urisdiction.l.ies w1~.olly or partially
within. the county, whose functions inc~ude recommen.dation, preparing
plans ~or or constructing, ma~or publ.ic works, shall submit to an
official agency as designated by the County Board of Supervisors a
proposed I.ist of public works during the ensuing fiscal year, a~nd
WfiEREA5, the department of public works has been handling
this function as a matter of practice in the past.
NpW, TH~R~FORE, ~~ IT IRESOT~V.~D by this Board:
1. That the public works depaxtment i.s h.ereby designa~ed
the official agency to list and c~.assify al~. recommended public
worlcs projects and shal~ prepare a cQOZdinated prograiu of proposed
public works for the ensuing fiscal. yeax al.~. pursuant ta the
provisions of Government Code §6540~.
2. Th.at afte~ the public works depaxtment prepares
said coordi.nated program of proposed publi.c works it shall subznit
same for review to t~e ~utte County Plamn.ing Comznissiom for said
commission's review and report to public works as to conformity' of
said coordinated program with the Geztex'al. Plan of Bukte County.
3. That all public agencies affected shaJ.J. submit the
proposed projects for the ensuing year to th.e Sutte County DeparCmenC
of Public Works by March 1 of the previous year.

4• The departmen~ of public works shail submit said coordinatad
program for the ensuing year to the Butte County planning Commission
for rev~ew relative to conformity with the General Plan by April 1
of the pzevious qear.
5. The Butte Coun~y Planning Com~-ission shall review said
coordznated program of proposed pubiic works ~or the ensuing year as
to conformity with ~he General P1an and report their findi~gs back
to the public works department by June 1 of the previous year.
6. As ~o all county pro.jects the public works departmen~
sha11 report the aforementioned findings and deterzninations of the
Planning Comnission as to conforrnity to the Board o~ Supervisors
prior to the inclusion of the proposed county pub~ic works projects
in the budget for the ensuing fiscal year. The public works depart-
ment shall also transmit the determinat~ons of the Bu~re County
Planning Commission to all of the other agencies ~hat have submitted
their proposed public wozks projects im~ediately ~pon report
thereof from the Butte County Planning Coam~ission.
