EMINENT DOMAIN NECESSARY FOR TkIE CONSTRUCTION OF A COUNTY
HIGHWAY KfTOWN AS OROVILL~- tTINCY ffIGHWAY ~k27561-73-]. IN
THE COTfiTTY OF BUTTE STATE OF CALIFORNIA
BE ZT RESOLVED by the BOARD OF SUPERVISORS of the County of Sutte,
State of California, that said Board finds and deCermines and hereby declares,
as follows, to wit:
I, That public inCerest and necessity require the acquisition,
construction and comp7.eti.on by the County of Butte, of a public impovement,
namely a county highway known as Oroville-Quincy Highway, in the County of
Butte, State of Ca1i.~ornia,
2. That public interest and necessi~y require the acquisition for
-sa~d i~nprovement of the real property, or in~exest in the real property
hereinafter described, together with a11 improvements situate thereon, and
S.t is hereby found and determined that the construction of a county highway
is a public use, authorized by law, and rhat public interest and necessity
require the construction of said improvements and the acquisition of said
real property hereinafter described, and aII improvements situate th.ereon.
3. Said proposed public improvement is Qlanned and J.ocated in a
manner which will be mosC compatible with the greatest public good and the
leas~ private injury.
4. ThaC Che Countq Counsel o€ the County of Sutte is hereby autho-
rized and empowered as follows:
{a) To acquire, in the name of the County of Butte, a fee si.mple
estate or such necessary i.nterests in and to the hereinafter-described real
property, or interest in real property, and all improvements thereon by
condemnation in accordance with ehe provisions of the Streets aztd Highways
Code, Code of Civil Procedure and the Consti~uCion of Che State of Californi.a,
relating Co~_eminent domain, to authorize the Auditor to pay £rom County funds

the costs and consideration for said acquisition, and the Aud"ztox is autho-
rized to make such payment on authorization.
(b) To prepare and prosecute for the County of Butte such proceedings
in the proper court having jurisdiction ehereof, and make such deposa.ts from
County funds for fees and costs as are necessary for such acquisition.
(c) To make application to said court for an order fixing the amount
of security in the way o~ moneys deposited as said court may direct, az~d for
an order permitting the Co~nty of Butte to take immediatie possession and use
of said real property, or a.nterest, or improvements in said real property,
as a right of way for a puflzc highway tor public use.
(d) To make deposit of such security out of proper funds under the
control o€ the County o~ Butte, in such amounts as fixed and determined and
in such manner as said court in which condemnation proceedings are pending
may direct, and the Auda.tor is authorized to make said deposi~ immediately
upon the court maki.n,g said order.
5, The real property, or interest in real property, and/or improv2-
ments thereon, which the County of Butte is, by this resolntion, authorized
to acquire tor said public improvementis in fee simple, is situate in the
County o£ Butte, State of California, more particularly descri.bed xn Ea~hibits
