(1) D~'S'ERMINING THAT THE PU~LIC COI+7~ENIENCE AND IVECESSITY REQUIRE IMPR4VEMENTB AND ACQ[JISITTOI~TS TO BE MADE AND PAID FOR BY SPECIAL ASSESSMENTS, AND ' {2) DETERMTNTNG THA~' THE SPECIAL ASSESSMENT INVESTI- GATION, L~MTTATION AND MAJORTTY PFtOTEST ACT OF 1931 SHALL NOT APPLY TO PROCEEDINGS THEREFOIt. WHER~AS On Oc~ober 7, 1975, this Board adopted RESOLUTION N0. 75-147 (1) Declaring that Public Convenience and Necessity Require Improvements and Acquisitians in Sacramento Avenue Assessment Dis~rict No. 1, and (2) Setting Time and P1ace for a Hearing Respecting the Public Convenience and Necessity to~ said ~mprovements and Acquisitions, and [~EEREAS, this Board set November 18, 1975, in said Resolution No. 75-147 as the date for hearing all persons interested in the matters contained in said Resolution No. 75-147, and WHEREAS, the Clerk of this Board has ~i].ed his affidavit showing that on October 31, 1975, he.caused to be mailed a notice to each property owner in said SACRAMENTO AVENi7E ASSESS- MENT DISTRICT N0. 1 stating the time and place of a hearing on the mat~ers contained in said Resol.ution No. 75-147 and containing all other matters.this Board directed the Clerk to in.c~ude in said notice, and WTiE12EAS, the County Surveyor-Di'rector of Public Works has filed his affidavzt showing that on November 3, 1975, and ~ through November 5, 1975, he caused notices to be pos~ed on the streets in said SACRAME13T0 AVENUE ASSESSMEN~' DTSTItICT NO. 1 ~ - 1 - stating the time and place of a heari~g on the matters contained in sazd Resolution No. 75-147 and containing all other matters this Board directed said County Surveyor-Di~ectoz of Public Works to include in said notice, and WHEREAS, on October 28, 1975, and October 29,1975, the Cierk duly published in ~he Chico Enterprise-Record a notice stating the time and place of a hearing on the matters contained in said Resolution No. 75-147 and containing.all other matters this Board directed the Clerk to include in said notice and an affidavit of the said Chico Enterprise~Record has been filed showing said publication was done on said dates, and __ WHEREAS~ this Board has heard all persons so objecting that desire to be heard and has considered al~::such object~ons, iQOW THEREFORE, RESOLVEp BX THE BOARD OF SUPERVISORS OF fiHE COUNTY OF BUTTE, S~A~E OF CALTE'ORNIA: 1. That this Board fa.nds that each of the reca.tals stated above is true. 2. That this Board finds and determines that the public convenience and necessity require that the County of Butte construct the improvements that are described or referred to in Resolution 75-147 adopted by this Board on October 7, 1975, in and adjacent to the area in this County that this Board has by its Resolution No. 75-147 designated SACRAMENTd AVEi~TUE ASSESSNL~NT A~STRICT NO. 1, and this Board further finds and determines that the public cpnvenience and necessity require that the County of But~e acquire all rights of way, places, and properties necessary for constructing said improvements and that this Board determines that said work and improvements and acquisi- tions shall be paid for by special assessments levied on lands in said SACRAMEi~TO AVEI3UE ASSE$SNiENT D~ST7tTCT A70. 1 and that this - 2 - Board determines that none of the provisions of the Special Assessment Investigations~ Limitation and Majority Protest Act o~ 1931 shall apply to ~he proceedings wherein said work and improvements are done and said acquisitions are made and the special assessments therefor are levied. 3. That this Board determines tha~ the work and improve- ments and acquisitions and special assessments therefor and all proceedings for the same sha~l be done purauant to the te~ms and provisions of the ~mprovement Act of 1911. 4. That this Board hereby denies all objections filed and presented respecting the matters contained in said Resolu- tion No. 75-147: 5. That this Board hereby directs the County Surveyor- Director of Public Works to prepare and to present to this Board, or to obtain and presen~ to this Board where required by law, plans and specifica~ions for doing said work and constructing said improvements toqe~her with careful estimates of the costs and expenses thereof.
