RESOLVED BY THE BOARD OF SUPEI2VISORS OF TIiE COUNTY OF BUTTE~
STATE OF C.F~LIFORbII.A:
1. That GALE E. PECR r~'~~p~'~e~r at LaW, be and he
is hereby employed by this Board to consult upon the preparation
o~ and review and agprove all legal documents and resolutions,
for a~proceeding to be taken by this Soard under the Municipal
Improvement Ac'~ ot 1913~£or a proposed Assessment Dis~rict
to be known._ as

2. That said GALE E. PECK, Attorney a~ ~,aw, be and he
a.s hereby further employed to furnish his professional opinion
as to the legality and enforceability of the bonds to be
issued bx said assessment district, said opinion to be furnished
to and shall be for the benefit of the person, ~irm or
corporation to whom•this Board sel~s said bonds.
3. That the County of Butte shall pay to
GALE ~. PECK, a sum equal. to three percent (3~) of the amount ,
o£ the cons~ruction cost of the improvemen~s as se~ for~h in
the assessment levied upon ~he lands within said district, for
his services above describec~, provided that said suan shaZl be
payable to him solely from moneys received from the sa~e
of improvement bonds issued under the proceedings above
described and that said sum shall be due and payable to him
after the sale and delivery of said bonds. That said
pompensa~ion does not include any fee for services rendered
in connection wa~th ].itigata.on concerning said bonds. •

pn a motion by Supervisor Richter , seconded by
Supervisor ~adigan , the foregoing resolution was passed
and adopted by the BOARD OF SUPERVISORS, COUNTY OF BUTTE,
STATE OF CALIFORNIA, ~his 9~h day of March , 1976.
