(b) Toprepare and prosecute for the County of Buttie such proceedings
in the proQer- court having jurisdiction thereo~, and make such deposits from
County funds for fees and costs as are necessary £or such acquisition.
(c) To make application to said court for an order £ixing the amount
;of security in the way of moneys deposited as said court may direct, and for an
iorder permitting the County o~ Butte to take immediate possession and use of
!said real property, or interests, or improvements in said real property, as a
'.'rmght of way for a public highway for public use.
(d} To make deposit of such security out of proper funds under the
control of the County o~ Butte, in such amounts as fixed and determined and in
such manner as said court in which condesnnation proceedings are pendfng may
cdirect, and the Auditor is authorized to make said deposit immed9.ately upon
'the court maka.ng said order. '

A parcel of land situated in the northwest quarter of Section 28, T26N,
R4E~ NIDB&3~, more particularly described as follows:
Commencing at the west quar[er corner of aa_id Section 28; thence N87°51`16"E,
38.00 feet, along the south J.ine of the said northwest quarter of Section 28
