RESOLUTION A,ND ORDER PREL2MZ~7ARILY ADOPTING ENGINEER'S
REPORT, S~;TTING PUBi~IC HEARING AND CALLTNG FOR BIDS,
CLARK ROAD ASSESSMENT DISTRICT NO. 1, COUNTY OF BUTTE,
STATE OF CALIFORNIA
E~IHEREAS, on the 7.st day of July, 1975, the Board of
Supervisors of the County of~Butte, State of Cali.fornia, adop~.ed
its Resolution of ~ntention for the improvements xn Clark Road
AsSessment District No. 1, County of Butte, State of California,
and referred said improvements to CLAY CASTLE~3FRRY, Dizector of
Publ.ic Works of the County of Butte as Engineer of Work for said
assessment distrzct; ancl
WH~R~AS, said Board of Supervisors directed that said
Engineer oE Work make and fa.l.e with the County Clerk of the County ~
of Butte, a report in writing in accordance with the provisions
arid requirements o£ the Municipal Improvement Act of 19~.3 of
the Sta~e of California; and ~
WIiEREAS, said ~'ngineer of hTOrk did, on the 16th day
of March, 1976, file wi.th the County Clerk o£ the County of Butte,
a report in aocordance with the said resolution, and said County
Clerk has pre~ented the report to this Board far consideration;
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors
of the County of Butte, State of California, and this Board hereby
~inds: . ~
1. That the report made and filed by the Engineer of Work
on the 16th day of March, i976, contains a11 0£ the requirements
provided for said report by the provisions af the Municipal Im-
provement Act of 1913, including (1) speczfications; (2) plans
and prafiles and estimates of cost; (3) assessment diagram and
assessment; (4) descriptions of easements and/or rights-of~way
to be acquired. •
2. That said report, and each and every~part thereof,
3.~ sufficient in every particular, and it is hereby deteimined

that said report shall stand as the report for all subsequent
proceedings under said Munioipal Improvement Act of 1913; and
SE ZT FURTHER RESOLVED that Tuesday, the 20th day
of Apri1, ~976, at the hour of 10:30 o'clock A.M. of•said day,
at the meeting place of the Board of Supervisors af the County of
Butte, located in ~he Butte County Courthouse, 1859 Bird, Oroville,
California, is hereby fixed as the time and pZace for hearing
protests with relation to the proposed improvements described
in said repost; that any person interested in objecting to said
improvements, the grades to which the work will be done, or has
been done, the extent of the assessment district, the assess-
ment, or the engineer's estimate of cost and expenses, or any
other act or deter.nination af the Board ~f Supervisors or the
Engineer of Work o£ the assessment district may file pro~est
in writing with the County Clerk of the County of Butte at ar
befo~e the haur fixed herein for hearing thereon; and
B~ IT FURTHER RESOLVED ~hat the County C1erk of the County
of Butte be, and he is hezeby, directed to publish a Notice of
Improvement pursuant to Section 6066 ot the Government Code af
the State of California, the first of which said notices to be
first published at least twenty (20) days prior to the date herein
set for hearing of pro~es~s; and
BE ~T FURTHER RESOLVED that the County Clerk of the
County of Butte be, and he is here~y, further direvted to cause
Noticas of Improvement to be posted on alI of the open streets
within the district described in the Resolution of Intention
at not more than three hundred fe~t apart on each street so posted
~n accordance with the requirements of Sections 1Q302 and 10303
of the Municipal Improvement Act o£ 1913; and

BE IT FURTIiER RESOLV~D that notices.of the adoption
of ~he Resolution of Intention arid filing of the ~ngineer's Report
shall be mailed, postage prepaid, to ail persons owninq real
property to be assessed whose names and addresses appear upon
the last equalized assessment roll for taxes, or as known to
the County Clezk. Saifl notices sha~l contain the matters re-
qnired in Section 10307 of the Municipal Tmprovement Act of 1913
of the State of California.
BE IT FURTAER RESOLVED that this Saa~d hereby prelimin-
arily orders that the improvements described in the Resolution
af Intention be had and done in accordance with the plans and
specifications and prof~les for said work. The plans and speci-
fications with saxd report are hereby adoptied as the plans, pro-
files and specifications for the doing of said work and improve-
ments, and said Board hereby orders that bids shall be received
for the doing ot said work and improvements pn the 8th day of
April, I976, at 11:00 o'clock A.M. of said~day. Said bids dr
proposals shall be delivered on or before 11:00 o'clock A.M.
of the"8th day of Aprii, 1976, at the o~fice of the Directior of
Public works of the County of Butte, 7 County Center Drive,
Oroville, California, which said time and place are hereby fixed
as the time and place of a public meeting at which said bids
will he publicly opened, examined and declared by the Directa~
of Puhlic Works of the County of Butte. Said bids after being
publicly opened, examined and declared, wiZl be calcuZated by
the Engineer of work. his report returned to the County Clerk
and the repozt of the results a£ the bidding and the calcula-
tions of the Engineer of Work wxll be reported ~o the Board of
Sugervisors o~ the County of Butte.

The Board of 5upervisors reserves the right to reject
any and a21 proposals or bids should it deem this necessary for
the public good, and also the bid of any bidder who has been
delinquent or unfaithful xn any foxmer contract with the
County of Butte.

I HEREBY CERTIFY that the foregoing resolution was duly and
regularly adapted by the Board of Supervisors of the County of Butte,
State of California, at a regular meeting thereof, held on the 16th
day of March, 1976, by the following vote, to wit:
