REPORT, ORDERING CONSTRUCTZON OF IMPRQVE~ENTS ANb
CONFIF2MING ASSESSMENT, CLARK ROAD ASSESSMENT DI5TRICT
N0. l, COUNTY OF BUTTE, STATE OF CALIFORNIA
WHEREAS, on the lst day of July, Z975, ~he Board of Super-
visors of the Connty of Butte, State of California, adopted its
Resolution of Sntention zn Clark Road Assessment District Nb. 1,
County of Butte, Stafie of California, for the cons•tructinn of
improvements in said assessment district and referred said pro-
posed imprpvem~nts to CLAY CASTLEBERRY, Direa~or of Pubiic Works
of the County of Butte as Engzneer of Work for said assessrnent
district; and
WHEREAS, an the 25th day of March, I976, the said Engineer
of Work filed an Engineer's Report, Assessment and Assessment
Diug~an in accordance with said Resolution, and said Engineer's
Report was presented to the Board of S~pervisors of the County of
Butte for consideration; and
WHEREAS, on the 16th day of ~darch, 1976, the soard of
Supervisors of the County of Bu~te preliminarily adopted said
Engineex's Report and fixed Tuesday, the 20th day of April, 1976,
at the hour of 10:30 o'clack A.M. of said day, at the meeting
pZace of the Board of Supervisors of the County~of Butte, located
in the Butte County Courthouse, 1859 Bird, Oroville, California,
as the time and place for hearing protests with relation to said
proposed improvements; and
WHEREAS, pursuant to said Resolution hereinabove men-
tioned a Notiae of Imprave~aent was duly pub],ished, posted and
mailed~ giving notice of the ~ime and place of hearing on said
Report; and '

WHEREAS, on the 20th day ot April, 1976, said hearing
was he~d; and
WHEREAS, on the 20th day of ApriZ, 1976, the Board of
Supexviso~s of the Cnunty of Butte directed the Engineer of Work
to file an Amended Engineer's Report; and
WHEREAS, on the 20th day of April, 1976, the Engineer of
Work filed with the County Clerk of the County of Butte an Amended
Engineer's Report;
NOW, THEREFORE~ B~ Im R~SOLVEb by the Board of Supervisors
of .the County of Butte, State of California, that thzs Board does
hereby ~ind, determine and order as follows:
1: That the district benefited by saicl impzovements
and to be assessed to pay the costs and expenses thereof, is
more particularly described in the Resolution of Intention here-
inabove referred to and made a part hereof by reference thereto.
Said Resoiution of Intentian also excepts from the distrxct to
be.benefited the area of all public streets, avenues, lanes,
roads, drives, courts, glaces, public parks, and all easements
and rights-of-way therein contained belonging to the public,
and also aIl property owned by the County of Butte, the State
of California or the Onited States of America, contained there-
in~ now in usa in the performance of a public function.
2, That the plans and specifications.for the proposed
improvements be, and they ase hereby, finally adopted and apgrov-
ed as the plans and specifications to which said work shall be
done as called for in said Reso2ution of Intention.
. 3.. That the Amended Estimate of Cost of the itemized
and tota~ estimate8 cost and expenses of the improvements~ and
of the incidental expenses in`connection therewith, which said
Amended ~sti.mate of Cost is on file v~ith the County Clerk of
the County of Butte be, and it is hereby, finally adogted and
approved as the Engineer's total and detailed esticnate of the

costs and expenses of said improvements.
° 4. That the work and improvements to be made, as des-
cribed in the Reso~ution o£ Intention and the Amended Engineer's
Report on file with the Cnunty Clerk of the Caunty of Butte are
hereby approved, and all ot the matters contained in said Amended
Engineer's Report are approved and confirmed. The Board of Super-
vzsors of the County of Butte further finds that ~he public
convenience and interest require, and hereby arders the improve-
ments to be made as described in and in accordance with sa~d
Resolution of Intention and said Amended Enginee~'s Report.
Reference to both the Resolution of Intention and the Amended
Engineer's Report is hezeby made for a more particular descrip-
tion of the work and improvements herein approved, confirmed
and ordered.
5. The Board of Supervisors of the County of Butte
does hereby levy and apportion upon each and every lot, piece
and pazcel of 2and within the boundaries of the assessment dis-
trict t~e amount by which each of said lots, pieces or parcels
of land is benefited by the improvements. The amount of the
assessment which is levied and apportzoned upan each and every
lot, piece and parcel of land within the boundaries of the assess-
ment district is as shown on the assessment attached to and made
a part of t~e Amended Engineer's R~port adopted by this Reso-
lution. The Board of Supervisors of the County of Hutte hereby
finds and determines that each of said lots, pieces or parcels
of land within the boundaries of said district is beneFited in
the amount and in the proportion o~ the total cost of the improve-
ments, plus incidental expenses, which each of said lots, pieces
or parcels of land has been assessed in said Amended Engineer's
Report.

6. Collections of assessments shall be made by the
County Treasurer of the County of Butte.
7. In the event any surplus remains in the Improve-
ment Fund after the completion of the improvements and the payment
of all claims from the Improvement Fund, said surplus shall be
distributed in accordance with Section 10~l27 0£ the Streets and
Highways Code. ~

and regularly adogted by the Board ot Supervisors of the County of
Butte, State of California, at a regular meeting thereof, held on
the 20th day of April, 1976, by the follawa.ng vote, to wit:
