section on eminent domain 1aw (A, B. ii~ became totally o.perative
on July i, 1976; and
WHEREAS, the new California Code o~ Civil Procedu~e
sectio~ on eminent domain law requires that prior to adopting a
reso~ution of necessity pu~suant to Section 1245.235 California
Code of Civil Procedure, property owners must be given appropria~e
notice and opportunity to appear and be heard; and
WHEREAS, the County of Bu~te wishes to establish the time
for such hearing be set at 11:00 a.m. at :_each meeting of the Boa~d
of Supervisors.
NOW, THEREFORE, BE IT ~SOLVED that the Board of Super-
visors of the County of Butte, State of California, hereby se~s the
time of 11:00 a.m. at ~:each meeting of the Boa~d of Supervisors as
Che time for each person ~o appear and be hea~^d prior to adop~ing
a resolu~ion of necessity pursuant ~o Section 1245.235 California
Code of Cz.vil Procedure.
