HomeMy WebLinkAbout76-183~eso~ufion No. 76- 183 RESOLUTIQN ESTABLISHING TNE PARADISE ADUISORY COUNCIL WHEREAS, Government Code Section 31010 provides that the board of supervisors of any county may by reso~ution establisha muni- cipal advisory council for any unincorporated area in ~he county to advise the board on such ma~ters which relate to that area, and WHEREAS, it is desirable that a municipal advisory council be estabZished to cover the area cammonly known as Paradise in the unincorporated area of B~tte County, more particularly described in Exhibits 33A" and "S" attached hereto and made a part hereof as if set farth in fu]1. NOW, THERE~ORE, BE IT R~SOLVED: 1. A munic~pal advisory council is hereby established and designated "the Paradise Municipal Advisory Council" {hereinafter referred to as "Council") 2. DUTIES AND BOUNDARIES: The duty of said Counci7 shall be to advise the Board of Supervisors on such matters as relate to that certain area described in Exhibits "A" and "B" attached hereto and commonly known as Paradise Irrigation District (hereinaf~er referred to as "Paradise"), concerning services which are or may be provided ta said area by the Coun~y, including but not limited to, advise on matters of publTC health, public safety, welfare, public works, and planning. 3. COU~lCIL OPERATLON AN~ EVALUATION: (a) Bylaws for conduct of ineetings shall be prepared by the Counci1 and copy forwarded to the Board of 5upervisors. The Council shall select a chairperson according to rules adopted by the Caunci1. The Council shall meet at least monthly at an established time and place and shall advise the Board of Supervisors as circumstances require. Minutes of all meetings shall be pro- vided to the Board of Supervisors. The Counci] shall se7~ct an official representative or representatives to the Board of Supervisors. (b} An annual eva~uation by the Grand Jury af the County of Butte is requested to report in regard to the performance of the Council's advisory functions. 4. NUMBER AND METHOD OF SELECTION OF COUNCTL MEMBERSc (a) The Counc~l sha11 consist of seven members. (b) The first.members of the Council sha1T be appointed by the Board of Supervisorso Appointment shall be for a period of one year, or un~il their successors qualify for office. Their terms wil7 expire when their successors have been e1ected and qualif~ed. Conc~rrent with appointment of the members of the Council, this Board shall appoint a chairperson pro tem of the Councf1 for the purpose o~ calling the initia3 formation meeting. (c) Subsequent counci~ members shall be selected by i e~ec~ion, '; 5. ELECTIOfVS: Council members sha17 be e1ected at large. The term of office shall be for four years; exce~t in the initia1' election year the four candidates rece~ving the largest number of~ s votes shall serve a~Four year ~erm ar~d the three candidates receiving ; the next highest number of votes shall serve two year terms. Such terms to be on a staggered basis. Coancil member shall serve until a successor is elected and qualified. The Council shall be, elected by the electors of Paradise in the manner provided by tiie Uniform Distrtct Elections Act, the election sha11 be held to coincide with those e3ections held for the Paradise Irrigation ' District. Members of the Council may be recalled as provided in : ; the Un~form ~istrict Elections Act. Vacancies in the office of' 2. . council member sha]1 occur upon any event set forth in Governmen"t: Code Section 1770 and sha11 a~so occur if a council member is absent for three consecutive meetings and his absence is not excused by a majority of the remaining council members. In the event a vacancy does occur, it should be filled by appointment by the Board of Supervisors.' 6. RESIDENCE AND VOTING REQUIREMENTS: All Council candfdates and voters in any such election shall be registered ' electors of Parad9se. 7. NEIGHBORING COMMUNTTTES: It is recognized ~hat certain concerns and problems exist, and are common, throughout the entire Paradise Ridge area which affect ~hat area. Therefore, i~ is intended that the Upper Ridge communities and Paradise may coordinate such common concerns and problems, for presentation to the Board of Supervisors. 8. FINANCING; The necessary and reasonable expenses of operating the Council shall be provided by the Board of Supervisors, provided, however, ~hat in no event sha17 said amount exceed the amount of $500 for the first year's operation. After their appaint- ment, the fYrst order of business af the Counci1 shall be to prepare a tentative budget to be forwarded to the Board of Supervisvrs for their approval. It is the intention of this Board to review the effectiveness of the Advisory Council in November of 1977, and at that time shall determine whether or not to continue the operation of said Council, provided further, however, the Board of Supervisors reserves the right to d~scontinue the Council a~ its discretion` at any tiroe.
