HomeMy WebLinkAbout763ORDINANCE NO. 763 1 AN ORDINANCfi OF THE COUNTY OF BUTTE, 2 STATE OF CALIFORNIAN ZONING A PORTION OF SAID COUNTY PURSUANT TO EXISTING ORDINANCE ,g NOS. 475, 522 and 676 OF SAID COUNTY AND AMENDING THE SAID ORDINANCES '4 The Board of Supervisors of the County of Butte, State of 5 California, under and pursuant to Ordinance No. 475 of said 6 County, being the Zoning Enabling Ordinance of said County as amended by Ordinance Nos. 522 and 676, Do Ordain as follows: 7 SECTION I. The hereinafter described area situate in the 8 County of Butte, State of California, shall be and it is hereby zoned as an "A-R" (Agricultural-Residential) District as herein- 9 after DESCRIBED AND SUBJECT TO ALL of the restricted uses appli- l0 cable to the uses of an "A-R" District, said area so zoned being located 2$n the Community of Paradise, particularly described as 'll follows: 12 Beginning at the intersection of the centerline of Bille Road and Sawmill Road; thence southerly !13 along the centerline of Sawmill Road to its intersection with the centerline of Elliott Road; 14 thence westerly along the centerline of Elliott Road ''15 to its intersection with the centerline of Clark Road; thence northerly along the centerline of Clark '16 Road to its intersection with the centerline of Bille Road; thence easterly along the centerline of Bille ''17 Road to the point of beginning, excepting therefrom that portion two hundred (200) feet west of Libby Road 18 and two hundred (200) feet north of Orput Lane to the Clark Road as described by map in the Office of the 19i Butte County Planning Commission. 20 ~ SECTION 2. Subject to only the exception provided in 21 Section 3, the District in its entirety shall be subject to the following restrictions, restricted uses amd regUlat~ons: 22 2.1 Uses permitted: 23 ,24 1) Single-family dwellings, not including tents or trailers. '25 2) Accessory buildings pertinent to permitted uses. 26 3 ) Agricultural uses, except livestock and poultry 27 ( farming. 28 2.2 TI)e following uses subject to the securing of a use 29 ~ permit in each case: 30 1) Tao-family dwellings and multiple-family dwellings. '31 2) Gmlf courses and country clubs. 82 3) Public and quasi-public uses including churches, fire houses, hospitals, parks and playgrounds,schools and public utility buildings. 7G3 !1 i2 3 4 5 6 '7 ~8 9 10 11 X12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 ', 27 28 29 30 31 32 4) Private stables. 5) Poultry farming and livestock farming. 6) Veterinary clinics. 2.3 Minimum building site area required: Eight-thousand, one hundred and twenty-five (825) square feet. 2.4 Minimum building site width required; Sixty-five (65) feet. 2.5 Minimum front yard required: Twenty-five (25) feet. 2.6 Minimum side yard required: Six (6) feet. SECTION 3. Additional uses permitted, subject to the securing of a use permit in each case:' 3.1 Land having frontage on Clark Road: General Commercial (C-2) Uses. Said Commercial area shall be developed to proper grade to the existing road. SECTION 4. A1L uses of land within the district not specifi tally authorized and permitted under Sections 2 and 3 are pro- hibited. SECTION 5. Penalties for any violation of the zoning hereby imposed within the District shall be as provided in the Zoning Enabling Ordinance. In compliance with the provision of the Zoning Enabling Ordinance, this Ordinance shall from and after its effective date become a supplement to and a part of the Zon- ing Enabling Ordinance. SECTION 6. This Ordinance shall be and it is hereby declare to be in full force and effect from and after thirty (30) days after the date of its passage, and before the expiration of fif- teen days after its passage this Ordinance shall be published once with the names of the members voting for and against it, in the :-~.-:P.a~adiise Post , a newspaper published in the County of Butte, State of California.
