A ZONING ORDINANCE ESTABLISHING REGULATIONS FOR THE.
USE OF LAND AND THE CONSTRUCTION AND USES OF BIIILDINGS
WITHIN THE PARADISE IRRIGATION DISTRICT.

The Board of Supervisors of the County of Butte, State of California,
do ordain as followsa

SECTION 1 NECESSITY: The Board of Supervisors finds that certain

regulations are necessary for_the preservation of the public health, safety
conaenience and general welfares pending the conduction of studies and surveys
and the preparatioaa and adoption of a Comprehensive Land Use Plan for the County
of Butte.

unincorporated area of"~'utte County, t`rlifornia, pat°ticularly described a,s
followse All properties lying within the Paradise Irrigation District.
SECTION 3. REGULATIONSe
__ ,._. _. 3.1__The_provisions o£ this Ordinance shall apply to all properties
lying within the Paradise Irrigation Districts excepting there from all areas
that have been detail..zoned_by__the Board of Supervisors.
3.2 IIaes pea°mittede The following uses are permitted within all
parts of the District, _ _
A. Lawful uses of land now established.
B. Dwellings and accessory buildings.
C. Agricultural uses and buildings.

usea_,of_land or_buildings.public_or,.quasi,public uses including schools churches,
public buildings public uti.litq buildings will be allowed without first securing
a Use Permit approved by the Planning Commission and the Board of Supervisors.
3,4 Additional Uses Permitted; In addition to the uses permitted
and authorized._under Section 3.28 and as an exception to Section 3.38 commercial
uses and buildings shall be permitted without the securing of a use permit within
the areas described as followsa
A. Land having frontage on the Skyway from the intersection
of Neal Road to a distance not to exceed five-hundred (500) feet north of Wagstaff
Road, and the depth is not to exceed three hundred and fifty (350) feet from the
centerline on the west side of said Skyway, and on the east side to the boundary
which coincides with the Southern Pacific Railroad rights-of-way. -

Southern Pacific Railroad right-of-way to Clark Road, and the depth not to exceed
three-hundred and fifty (350) feet from the centerline of Pearson Road on each
side.
C. For property having flrontage on Clark Road five-hundred
(500} feet south _o£ Buschmann Road to.five-hundred (500) feet north of Pearson
Road, and the depth shall not exceed three-hundred and fifty (950) feet £rom the
centerline of. Clark Road on each side.
D. For property having frontage on Clark Road, five hundred

(500) feet north and. south of Elliott Road to a depth not to exceed three-
hundred and fifty (350) feet from Clark Road on each side.
E. For property having frontage on Clark Road, fine-hundred
(50D) feet. north and south of Bille Road with a depth not to exoeed three-hundred
and fifty (350) £eet from the oenterline of Clark Road on each side.

SECTION 4, ADDITIONAL REGULATIONSa.
4.1 The following regulations shall apply i.ra all parts of the
District:
A. Building Setback Linea Required: All buildings and
structures hereafter located within.-the District shall comply with County Ordinance
#5D6, the Uniform Setback Ordinance,
B. Minimum''Buildiiag Site Required: Each single family
residence shall be located og a sitg not less than eight thousand, one=hundred
and twenty five (8'125) square feet' and said residence shall be located not less
than six (6) feet from the side line of the builditag site.

&. Minimum Building Site Width Required: Sixty-five (65) feet.
_.. _ 4.2 In eases where compliance with the provisions of this section
will result in undue hardship., a variance may be approved in-the manner prescribed
for the.. handling of a Use Peaynit..
SECTION 5. USE PERMITS:
$.1 Application for a Uae Permit shall be made to the Butte County
Planning_Commission and such application shall include a description of the
requested_.t~se_and shall be accompanied by plans showing the location of proposed
buildi~aga..or proposed alterations, locations of driveways and parking areas,
advertising structures and other iraformatioh as may be required by the Planning
Commission<
5.2 The findings and recommendations of the Planning Commission shall
be submitted to the Board of Supervisors.

Said Board of Supervisors sh~11 render its decision within sixty (60) days after.
the date of the.filing.of such appeal.
5.4 Revocations
A° In any case where the conditions imposed by the Use Permit
have not been complied withs the Planning Commission shall give the permittee a
ten._(10)_dalr notice,._ Ifs at the end of said ten (10) day period the permittee
still_£a31a or. refuses to comply with the provisions of the Use Permite the Planning
Commission shall. have ttae right to recommend to the Board of Supervisors that said
Use Permit be reeoked.
B. Iax any oase whea°e a IIse Permit has not been used within
one (1) year after the date of the granting thereofs the Use Permit shall be
automatically null and void.

5.5 The Planning Commission shall hold public ,hearings as
prescribed by law,
SECTION 6, VICLATICNSq Any. person violating arty of the provisions of
this Ordinance is guilty of a misdemeanor.
This Ordinance shall be, and is hereby declared to be in full force and
effect_from._and.aftea° thirty_(30),days_after the date o£ its passage, and before
the expiration of fifteen (15) days after its passage this Ordinance shall be
published once. with_the._names_of.the,membera of the Board of Supervisors voting for
and against it, in the $~$ Paradise Past ~ a newspaper published in the
County of Butte, State of California.
