designated Home Supervision Program to be funded in part from funds made
available through the Juvenile Justice and Delinquency Prevention Act of 1974
(PL 93-435), as amended, administered by the Office of Criminal Justice
Planning, hereinafter referred ta as OCJP.
NOW, THEREFORE, BE IT RESOLVED that the Chief Probation ~fficer of
the County of 8utte is authorized, on its beha~f, to submit the attached
Appiication for 6rant for Law Enforcement Purposes to OCJP and is authorized
to execute on behalf of the County of Butte the attac~ed Grant Award for Law
Enforcement Purposes including any extensions or amendmen~s thereof.
SE IT FURTHER RESOLVED that the applicant agrees to provide all
matching funds required for said proj~ct, incTuding any extension or amendment
thereof, under the Juvenile Justice and ~elinquency Preve~tion Act and the ru3es
and regulations of OCJP and the Law Enforcement Assistance Administration and
that cash will be appropriated as required thereby.
BE IT FURTHER RESOLVED that grant funds received hereunder sha17 not
be used to supplant law enforcement expenditures controlled by this body.

The purpose of ~his gran~ applica~ion is to implemen-~ the provisions o~' Wel~are
and Institu~ion Coc1~ Sections ~I~O and g41. wh.ich were manda~ed upon co~-~ies as a
resul-~ af the passage of Assembly Bill 3121 which became effeetive an Ja.nuary l,
1977. ~'unds made availa~le ~o ~his projec~ will be used by Bu~~e Co-~an~y ~o come
into co~nplaance with changes in California 1aw aff~c~~;c1 by Assc:mb~.y Bi~.1 312~..
Projec~ evaluation wi1~ inc~.ude a determ~.nat~.on o~' cost sav~ngs or increases
occasioned by compliance and assessment of cost benefit in ~erms of project objectives.
Problem sta~emen~
Assembly Ba.ll 3121 which became effective January l, 1977 added, in part,
Sec~ions ~/~0 and g41 to ~he Ca1i~'ornia We1~a~e & Ins~~,tu~ion Codes.
Section ~/~0 of the Welfare & Ins-~itu~ion Code, sta~es:
"There sha11 be in each. county probat~.an department a program of
home supervis~.on to which minors descri€~ed by subdivision (a) of
Seetaon b2~.1 shall be referred. Home su~ervision is a prograrn in
which persons who would a~herwise be detained in the Juvenile Hal3 are
permitted ~o remain in their homes pending court disposi~ion af their
cas~s, ~dc~r the s~zperva.sion of a probata.on o~'ficer or probation aide."
Sec~~on 8L,.7., s~ates:
"The duties af a probation officer or probatioxi. aicle ass~gned to
hame supervision are ~o assure the minor's appearance a-~ probation officer
interviews and colzrt heara.ngs, and to assure that ~he ininar obeys ~he
conditions af his rel.ease and permits no public affense pendin~ fa.nal
disposition o~' his case. A proba~ion officer or aa.de assigned ~o home
superv~sion shall have a case load of no more than ten minors. When-
ever possible, a mir~or sha11 be assignec~ ~o a proba~ian offacer or a~de
who res~.des in the sa.~e community as the minox."
Prior to the mandates o~' AB 3~.2~. the Butte County Probation Department did not
opera~e a home supervision program. In addition, ~he s~aff~.ng o~' probation officers
~.n comparison to case ~.oad was such tha~ i~ comp~.e~ely prohibated compliance w~th
Section ~/~1. Iieretafo~e a~ any given ~ime thex~e wers 17 to 20 y'o~zths without ~he
benefi~t o~' home supervisian who w~re simply ~urned loose with litt~e or na super-
vision at all. The table be~.ow, in -~erms of percentage, re~'lects the juvenil.es
who were rel.eased prior to their de~ention hearing, detained by the cour~, or
rel~asad by the court at their de~en~ion hearing. These percentages reflect ~he ~.ast
quar~er of ~he 1g76 calendar year, which was immedia~ely p~ior ~a ~he implementation
of A.B 37.2~..

The Butte Caun~y 1'robation Dffice pxoposes to candue~ ~he projec~ in accordance
with Sec~~.ons ~/~0 ancl ~41 of f~he Welfare &~~stif~utaon Code . To ~his end, the
Degar~men~t a.s required to provide daily contac~ with minors, and -~hear family or
guardians during the time pending the various cour~ appearances that are requ~.xed.
The probation s~a~'~` will provide wha~ever community resources ~hat are ava~lable to
a.ssist the m~nor in beginning to make a more adequate community adjustment.
Tt is praposed that ~he requested staff' of twa probation o~'fa.cers will be
suf'~'icier~t~ in view of the caseload to carry out ~the objec~ives o~' the program. The
probation aff~cers ass~gned to ~his program wi~.l repor~ directly to an ar~-staff

officer thra~gh the depa~t~ent chain of co~nmand. Supplemental ~raining will be
provi~ed thx~ough the Butte Comanunity Col~ege Regional Criminal ~ust~ce ~raining
Center as relevant courses are made available.

ef~'ec~tiveness is basically how we1.~. th.e Butte Coun~y Pra~bat~.on O~fice adherc:s to
the require~.~nf~s of Welfare & Tzastitutions Cade Sec~a.on ~/~l. The Departmen~ wi~l
a~temp~ to provide home supervisa~on to one hundred per cent of ~he ~ualifying
juveni~.es. In so doing, they will be workang with. the minor to ~:nsure th.e minor's
appeaxance at each agpointment and a~ al~ schedulec~ cour~ appearances. The
probation officers wil~. alsa be focusing t~pon the problem wh~ch bx~ought ~he jutrenile
to cour~ an ~he ~'ixsf~ place.
