HomeMy WebLinkAbout77-081WHER~AS, under Section 312 of the Housing Act of 1964 as amended (herezn
referred to as Section 312), the Secretary of the Department of Housing and
Urban Development has authorized, under the conditions and to the extent
provided therein, to make ~ection 312 loans to owners and tenants o~ property
in certain areas for the rehabzlitat~on of their pzoperty and to delegate to
or use as agent any locaZ publ~c agency or organizatiom to the extent deter~ined
appropriate and desirable by the Secretary to carry out the objectives of
Section 312 in the areas invoived; and
WHEREAS, Title Vz of the Civil Rights Act of 1964 prohibits discrimination
on the basis of race, color, or national origin under any program or activity
receiving federal financia~ assistance and Executive Order 11063 prohihits
disc=imination on the basis o£ race, colox, cxeed, or national orzgin in the
sale, lease ar other d3tsposition oP residential property ~nclud~ng Iand intended
for zesidential use or zn the use or occupancy thereof; and
WHEREAS, the Cpunty of Butte has the responsibility and jur3sdiction to
carry out a cou~unity development block grant program in the South Oroville
coumimnity, an area specifically designated by the County Board of Supervisors in
which Section 312 loans are authorized to be made; and
WIiE~EA5, it will benefit the rehabiliration objective of all such projects
and programs administered by the Board of Supervisors for the County of Butte
in which dxrect approval authority with respect to Section ~1~~;~~ans.
NOW, THEREFORE, BE IT RESOLVED by the Board o€ Supervisors o£ Buttie County:
1. That C1i£ Mickelson, Chxef Administrative Officer is hereby authorized
and directed to act as the avthorized representative.
2. That the Chief Administrative Officer is hereby authorized to submit
on behalf of the County of Butte, Section 312 loans to Che Department of Houszng
and Urban Development, in accordance with the poLicies adopted by the County as
well as those adopted by the Department of Housing and Urban Development with
respect to the Sectfon 312 program.
3. That the Uaited States o€ America and Lhe Secretarq of the Department
of Housing and Urban Aevelopment be, and they hereby are, assured of full
comp~iance fox the County of Butte with regulations of the Department of Housing
and Urban Development e€Pectuating TitZe VI of the Civil Rights AcC of 1964 and
applicabie executive orders. ;
