Pursuant to Sec~ion 504 of the Rehabilitation Act of 1973 (Public Law 93-1I2) and the Fair EmploymenC PracCices Ac~ (FEPA) commencing with Section 14i0 of the Labor Code, Agency agrees that no otherwzse quali.fied handicapped individual shall, solely by reason of handicap, be ex- cluded from the participation in, be d.enied the benefit o~, or be subject to discrimination in tre performance of this agreement. 6. Remedies for Wi11fu7. Violatian; (a) The State may determinE a willful violati_on of the Fair Employment Practices provision to have occurred upon receipt af a final judgement having that effect from a caurt in an action to ~ahich Contractor was a party, or upon ~eceipC o~ a written notice from the Fair ~mployment Practices Commission tha~ has investigated and determined that the Gontractor has violated the k'air Employment ~'ractices Act and has issued an order, under. The rapid increase in population and the consequent increase in the number of alcoholics requires a concerted effort to apply the best rehabil~.tation techniques in the most e£fective way, To meeC the problem of alcohoZism, diugnosis, treatment and rehabil~.- tation musC go liand-in-hand. Rehabilitation can help refluce the cost of maintaining the program of custodi.al care and ~reatment. It will reduce the cost to the 5tate economy in the lpss of individuaZs from the productive labor market. It will reduce the stigma and social prejudice that affects not only the individuals direc~ly con- cerned, but their families as we11. The respective agencies believe that mut~al agreement and cooperatian will develop the u~aximum utf.ii- zation of the resources of each agency toward the provision of improved reh~bilitation services to the eligible alcoho~.ic i.ndividuals of the county. I'~r each individual re~erred by the agency for vocational rehabili- Cation service~, t~rrtal Heal~h Services will provide diagnostic information which~~'as-`or can ma e avaiZable, as well as a statement of the services they will be providing and the goal.s of these services. A11 personal infQrmation, facts, and medical findings given or made nvaiZabJ,e to the vocational rehabiliCa~ion u.rzit, inciuding names and addresses, wilJ, be heid confidential in accordance with Che policiea and procedures established by the pepartment of ~tehabilita[ion in the Rehabilitation Services Manual, and the Caiifornia State Plan, and Welfare and xnstitutions Code, Section 199G9, Chapter I128, Statu~es 1975. Continue to provide treatment, supporL-ive therapy, and supervis~on which falls witha.n the ~ounty's normal arange o~ services during the pexiod the client receives voca~ional. rehabili- tation services and to pzovide reports to the State reg~rdzng progress with respect Lo the client's stability; 9. i~lake reCOmm~ndations when a client s~~c~uld be withdrawn From a vocational rehaba.li~a~ion p1an, E'. bFPARTM~NT OF 1~HA,gILITATION SERVIC~S ~ID RESPOiVSIBILITIES it is the intention of this cooperative program to combine the resources of the Department of Rehabil.itatio~ and Mental Health Serv~,ces to assist eligible aJ.coholic people, at or near~~ wor a.ng age, whose disability is a vocational handicap in tha~ it interferes with obtaining or niaintaining emp~oyinent. The essence of the program is the mobilization of all the resources of the disab~ed }~erson, the cooperating agencies and the com- munity to bring the disabled person tq his optimum ~unctioning level so that he can engage in suitabl.e empLoyment, The Bepart- m~nt o~ Rehabilitation will retain sole responsibiliry for final decisions relative to eligibility for vocational rehabili~ati.on serv9.ces and the nature and scope of scrvices to be purchased by the Department.~' The criteria of eligibility for vocational rehabil3.tation sezv~.~es est~bZished in the Feder.al Rehabilitation Act of 1973 are: ~ 1. The presence of an aicoholism disabili~y; 2. The existence of a substantial handicap to employment; a~~.d 3. A reasonable expectation that vocational rehabilitation services may be expecCed to render the inc~a.vidual fie to engage in a gainful occupat~on.~' The only persons who will be served by this cooperative program will be: Those in need of evaJ.uation to determine eI.igiba.lity for vocatf.onal. rehabili~ation services . 2. Handicapped persons caho are in need of extended evaZuation to determine eligib~.lity, 3. Fersons certi.fied as eligibla for vocationaL reha- bilitatian services. A1Z practices and procedures described in the Rehabilitation Services Manual shall be followed in the cooperative program. Any changes or revisions to the Rehabilitation Services Mattual affecting po].icy vr procadurea, become immed:f.ateI.y applicable to the cooperative programs and supersede the current procedures. `The requirements described in rhe foZlowing sections are in con- formity with,the requirements ot the Rehabilitation Services Manual. * ~'ederal Requirements 1'rogram services will be directed to~rard getting the elie~r~t irrto the . employ~rit market as soon as possib~e. 1`he actual time requ3red £or this wi11, og course, depend upon the particular needs, abilit~.es, work skills, problems, etc. of the individual client.
