WHEItEAS, the County of Butte has traffic signa}.s installed at varaous:
~.ocatians in the County, and
WHEREAS, tY-e Coun~y does not h.ave adequa~e personnel or equipment tor:
~he ma~.ntenance of such traffic signals;
NOW;: TH~RE~'ORE, BE IT RESOLVED that the Sta~e of Calitornia, Aepartment
pf Transportatian be requested to ma~.n.tair-sa.id signaJ. system at an. estimated
cast of ~3,D00 for the 1977-78 fiscal year.
l3E IT ~`UR'I'~iER RESOLVED that the following "Save Harml.ess" provisi.on
is appxaved by the Board in connectian with such maintenance:
"~t is expressly u~dexstood and agreed by the Coun~y that the Sta~e of
Ca7.~.forna.a and its o~ficers and a.ts empl.oyees sha11 na~ be answerable
or accau~table in any mannex for injuries to or the death of persoris`
or far any damage ~o property resulti.ng fxom the operation of or the:
~ailure ~o maintain the traffic signals." ; ;
"T#~,e County agrees ta indemnify and save harmless the Stare of CaZi~oxnia
and its o~ficers and employees fro~n a11 suits., actions or claims of any
characte~ brought as a consequence o~ the operation af or the fa~~.ure
to maintain the tra~fic si,gn.als."
