This notice of opportunity sha11 be extended at the time that iow-income families are noCified of any property to be sold, but may be exercised by BCHA oniy within a 14-day period following expiration of ~he period ext~nded to low-income families, WHEREAS, the County of Butte has acquired certain rea~ property as part of its co~aunity development bloclc grant program within the area generally described as the "Southside" neighborhood; and r WHEREAS, the County wishes to establish criteria governing the disposiCaon and sale of real proper~y acquired for cocmnunity development purposes. PTOW~ TI3EREFORE~ BE IT RESOLVED as follows: A. ~,xistzn~ Sin.~1e Familv Dc~rellinQs 1, To minimize the social disruption frequently associated with relncation, the County shall give Che right of first refusa2 to purchase to tenants, provided such tenanCS occupied the property €or a period of at least one year prior to acqui- sition by Che County and were tenants o~ record on the date in which Citle to the property vested in the County. 2. Zn the event the tenant £ails to meet tl~e above requiremene, or itf the event the ~enane meets that requzrement but ~ails to obtain the necessary ~inancing, the property sha11 be offered for sa7.e in accordance with the following priorities: c. If either of the above approaches fails to produce an acceptab~e purchaser, the property shall next be offered to moderate-income families on a first-presented, ~irst-considered basis, with priority being exCended to any o£fer t,~ich involves a moderate-income family that is faced with a documented imminent threat of displacement as a resvlt of governmental action, d, If a1Z of the above fail to produce an acceptable purchaser, the property shall next be offered to the generai market for a two-week period, on a highest bid basis. 3. A11 properCies to be sold by the County, purchased for community development purposes, shall be sold at a price not less than the fair market value, as determined by an independent appraiser and estabTished by tihe County. 4. The County may pay real estate co~nissions or fees in an amount not exceeding six (6%) of Che total sales price, 5. To be acceptable, any offer to purchase must include evidence of financing. 6. ~he County shall duly advertise the availability of properCies to be sold prior to the beginning of any sales period. , 7. Low- and moderate-income families sha11 be defzned as follows: a. A"low-income" family shall be a family whose annuai,income does not exceed 80% of the County's median income, with adjustment for ~amily size. b, A"moderate-income" family shall be a family whose annual income falls betu+een 80-120% of the Connty's median income, with adjust~nent for ~amily size. B. Sites Avaifable for Develo ent With respect to sites available for development, Che foliowing criteria shall apply: 1, If the site is designated for single-family low-~aud moderate-income housing, Che same critexia governing disposition of existing single family dwellings shall apply. 2, I~ the site is designated for muiti-family low- and moderate-income housing, the Butte County Housing Au~hority shall be given the first opportunity to purchase. 3. Any sites designated for genezal market housing, or for nonresidential use, shall be offered for sale to Che general market. Such sites sfiall be sold on a highest bid basis, un~ess otherwise specified by the County Baard of 5upervisors. 4. The Connty reserves the right to require that a11 sites sold within designated community development area(s) be subject to a"Dispositfon Agreemen~" which specifies the terms and conditions of site development and use, PASSED AND ADOPTED by the Butte County Soard of Supervisors this 20th day of September , 1977, by the following vote: AYES: Supervisors Madigan, Moseley, Winston and Chairman Richfier NOES: None ABSENx: Supervisor Lemke NOT VOTING: None ERNARD D, RTCHTER, Chairman of the Board of Supervisors ATTEST: CLARR A.
