HomeMy WebLinkAbout77-160ARESOLUTI~l~i ADO~'TING A~`d AM~N'DMENT TO THE LAND USE ELEMENT Ok' TFI~ BUTT~ COUNTY GE~TERAT~ PCAPd RECOG- NIZING ~XI3TING URBA?~ D~V~T~OPP~ENTS WHE~AS, this Board received from the Butte County Planning Commission, an amendment, a~.lowing recognition of existing urban development, to the land use element of t~.e Butte Count;r General P1an; and WHEREAS, pursuant to Govezn.ment Code §65355, hearings have been held by the Board of Supervisoxs to consider ~he above amendment; ;and "i~HEREAS, the Board of Supervisors has reviewed and considered and certified that the final ~nvironmental Impact Report (attached hereto as Exhibit "A") prepared for tb.e above amendmenC, was completed in complia.nce_ wi.th CEQ,A. o~ the State Environmental Guidelines; and WHE,REAS, notwithstanding rhe possible adverse environmental effects whi.ch may result from adoption of the amendment to the land use element, as described in the Environmen~al Impact Report pre- pared thereon, th~.s Board finds thar rhe present General Plan L•and Use Map ~ails to recognize existing uxban developments and serves as a barrier to the logical development of these areas and that ~this amendment is the most expe.~ient method of permitting such development to occur with resulting and social economic benefits; this finding being based upon the information presented at the hearing thereon be~oxe tbe Planning Commission and the Soard o~ ::: Supervisors and the research and studies on which the amendmext~ was based. NO~, THEREFORE, BE IT RESOLV~D by::t~e Soard of Super- visars ~of the County of Butte, State of California, that the land use e~ement of the Butte County General P1an be amended to znclude the fo~lowing: The scope of urbanization in unincorporated areas canno~ be effec~ively delineated on the land~use map of ~he C~eneral Plan because of the map scale and the wide dispersmen~ of ~he various urban uses. As a resulr, numerous isoZa~ed existing urban uses are not delineated on ~he lan~~ use map. In order to facilitate reasonable land- use patterns consistent with the intent of the General Plan; urban uses establishe~, which are not shown on the land-use maps and urban uses proposed which are contiguous to and surrounded by those established urban uses shall be considered to be ' consistent with the land-use element. It is not the intent of the Genera~ Plan to allow urban development radiating from such existing urban uses. Rather, it is the intent of the General P1an to recognize existing urban ~and-use which is not depicted on the land use map and to allow undeveloped land contiguous to and surrounded by such urban land-use to develop in a logical manner. BE IT FURTHER RESOLVED that, pursuant to Government Code ~65359, the General P1an of the County of ~utte be endorsed eo show that the above amendment has been approved by this Board. BE IT FURTHER RESO~VED, pursuant ~o Government Code §$65360, a copy of this resolution be transmitted to rhe City Council of the ci~ies of Sutte County. 2.
