RESOLUTION ESTABLISHING NNNICIPAL AIdD JUSTICE
COURT FILING FEES PURSUAI`IT TO BUSINESS AND
PROFESSIONS CODE §6322.I
WHER~AS, Che Legislature of this State has enacted AB1189,
which has been sigz~ied by t~Ze gov~ernor as an urgency matter and is
Chapter 1257 of the Laws of Z977, which act modified the relation-
ship between J'ustice and Municipal Courts, atnong other items in the
bill. '
PdOW, THEREFORE, BE YT ,~GREED as fp~.].OWS :
1. Pursuant to the authority of Business and Professions Code
§6322.1, the fee of $7.00 is hereby established to defray the ex-
penses af the 1aw library as additional cost relative to the provi-
sions of Business and Professions Code §§6321 and 6322.
2. Thi.s Board had previously, by Action No. 74-1817 of the
mircutes of December 10, 1974 of the Board of Supervisors meeting of
that :day, es~ab~ished a fee of $7.00, aIl pursuant to the
authority of Busiziess and Professions Code §6322.1 of the then
existing §6322.and §6321. The aforementioned action by the Board
o£ Supervisors, in essence, raised th.e law library fee to the maximum
allowed. Whez~ the'aforesaid action was taken by the Boar.d, §6322,
relating to the fee for appearances of rhe defendant, respondent or
adverse party or iziterveriing-party, did not apply to the 3ustice
Court, but rather merely the Municipal and Superior Court. zn that
Chapter I257 of the Laws of 1977 has amended Business and Pro~essions
Code §6322 to include Justice Courts, this Board hereby determines,
finds , ax~.d decrees 'that the $7 . 00 fee to def'ray the expen.ses of the :'.
library sha~.l be applicable as of the date of this resolution to the
Justice Courts as we11.
