JOSHUA TREE STREET LIGHTING MAINTENANCE DISTRICT ~~~~ ~~~ _. ~~:1~i'" WHEREAS, Article V, Ch~pter 20 of the Butte County Ordinance Code relating to subdivisioas in the County of Butte requires the establiahment of a sEreet lightfng spstem in new aubdivisions to be appraved in the Couaty of Butte pursuant ~ Co ihe provisiona of said Article V, Chapter 20; aad ~ WHEREAS, California Streets aad Highways Code Sectioa 5821.3 provides that a streeC Iighting maintenance district may be formed or the property annexed to an existfng maiatenance dietrict, without notice or hearing, when e atreet lighting eystem ia required to be installed 'by a subdivider; and . WftEREAS, on or about May 9r ~-977 ,~ tentative map of the Joshua ~ee #1 wae approved by the Subdivision Review Committee of the Countq of Butte requiring among other thinge the installation o£ a~treet iighting system as provided for in Article V Chapter 20 of the Butte CounCy Ordinanee Code; and WHEREAS, a petition by the 5ubdivider, Don Drake, hae beea filed with this Board, requesting the formaCion of a etreeC lighting ma~aGenance di~trict uador•the provi,e'o~s•.of the Impr~vemenC Ac~ of t411 (Chapter 26, Yart 3, Division 7, Section 5820 et seq.;); and WHERBAS~ public interest and cpnvenience require the formation of a streeY • 13ghting maintenance district hereinafter referred Co as Joshua Tree Street I,ighting Maintenance~District for the purpose of defraying the expensea. Y maintenance and oQeratioa o£ aa el.ectrfcal street lighting system. Said system wfll consiat of pol.es, kughts, posts, wiree, Iamps, and other necessary equipment installed in the hereinafter describe& unincorporated territory of the County of Butte, State af California. Sai.d eyetem is to be locaCed on and will light portioas of public ways in said streeC lighting mainteaance diatrict. The lighting system that wfll be operated and m~~nt~ined consiats of overhead service atreet lights which are suspended aver the ekreets from brackets or arms fastened to poies; and WHEREAS, the operation of khe lighting syatem shall consist o£ aupplying the lamps with electric energy for a~l night burning and switching them on and off once each night fn accordance with standard switching sckedules approved by the ~ublic Utilities Commission of the State of Caiifornia. Mei~tenance shall consfat of replaciag the lampa w~hen they burn out and of keeping Che system in good operating order; and , WHEREAS, this Board of Supervisors doea hereby determine and declare that the e~enees of maintaining and operating said eCreet lighting syatem herein described wili be assessed upon the laeds lying within the eaid atreet lighting maintenaace diatrict~ that Che monthly ratea charged for said street l~ghts shall be in accordance with filed echedules approved by the Public Utilities Cflmmiasion of the State of Ca11£ornia; and WHEREAS, sll o~ eaid lands lying within said street iighCing maintenanae district will be benefiCed by the maintenance and opezation of said street lighting syatem. The territary within said street iighting mainCenance district ia situated in the County af Butte, State of Ca1i£ornia, and is more particularly described hereinbelow. NOW, THEREFORE, BE IT REEOLVED BY THE BOARD OF SUPERV~S4RS OF THE COUNTY OF BUTTE, STATE OF CALIFORNIA, that a streeC 1lghting maintenance district under the pxovistons of the Improvement Act of 1911, (~apter 26, Part 3, D~viefon 7 nf the Streets and Kighways Code of the State o£ California is hereby formed and created. A~~NTION ia hereby cailed to the map of the territory to be included w3thin said stireeY lighting maintenance dietricC ehowing rhe public eays to be lighted, the appxoximate location o£ tihe lighta to be mainrained and operated therein~ . and the iands to be benefited by tihe mainrenance and operakion nf maid district -a- a ° d~ ~ Ct~ :D ~ a ~ ~. ~ -~ which landa are to be assessed to pay the expenses thereof. BE TT FtTRTHER RESOLVED that the Clerk o~ this Boaxd is hereby authorized and directed to file a copy of this Resolation in the office o£ the CounCy Asseseor, ~ -m .. - aad further, the County Assessor shall thereafter in making up the County Assesement Roila segregate the property included wi.thin khe district on the Asaesament Rol.l under the designation contained 3n this Resolut3.on as required by Section 5829 of the Streets and Nighways Code. BE IT FURTHER RESOLVED that the Clerk of this Board is authorfaed and dfrected to file a copy of this Resolution and forward same to the State 8oard of £qualiaetion, Valuation Division, Sacramento, California.
