HomeMy WebLinkAbout772ORDINANCE N0. 772 ORDINANCE ADOPTING PROCEDURE FOR LAND DIVISION OTHER THAN SUBDIVISIONS FOR THE COUNTY OF BUTTE, STATE -0F CALIFORNIA The Board of Supervisors of the County of Butte, State of California, do ordain as follows: SECTION 1. AREA OF APPLICATION: This Ordinance shall apply to all unincorporated territory within the County of Butte, State of California. SECTION 2. PURPOSE: The Board of Supervisors of the County of Butte, State of California, finds that certain regulations are necessary for the protection of public health, safety, convenience and the orderly development of land in the County of Butte. SECTION 3. PERMISSION AND REQUIREMII~TTS: When an owner of real property desires to divide land, not otherwise permitted by statute or ordinance, so as to produce not~more th~.n a total of four parcels9_and when said owner is not required by State. law to record a subdivision.map„or a record of survey map, and no dedication of public thoroughfares are involved, said owner shall comply with the provisions of this Ordinance as follows: (a) The approval of the Board of Supervisors of Butte County shall be. obtained before the actual division of any land covered by this Ordinance. (b} To acquire approval, a map, 11" x 17", of the proposed division of land, along with five copies thereof ;, at a scale: upon which the division ma be ie itil delineated, shall be filed with the Department of Public Works, Suoh map shall show: 1, Boundaries, with courses and distances of the parcel of land to be divided, and the courses and distances of the proposed division. 2. Approximate location of parcel involved, existing buildings and permanent structures. 38 Width and location of all existing or proposed public or private easements.- 4. Name, locations width of ar°ao~s or streets which provide access to the parcels resuZting.frgm a proposed land division.. ' 5a Where_topography_influences the proposed division of land, or drainage is required,., approximate contours and percentaae_arades_o~_roads or streets shall be shown drawn to intervals prescribed by the Director of Public Works of the County of Butte. 6. Locations and width of water courses or areas subject to inundation. 7 7 Z- SECTION 6. PENALTIES: Any violation of ar-y provision of this ordinance shall be a misdemeanor and shall be punishable by a fine of not to exceed $300,00 or by imprisonm®nt in the County Jail for a period of time not to exceed 90 days, or by both such fine and imprisonment. This Ordinance shall be and it is hereby declared to be in full force and effect from and after thirty.(90) days after the date of its passage, and before the expiration of fifteen (15) days after its passage this Ordinance shall be published once, with the names of the members voting for and against it, in the nrnvilla,]~a~rn~~, , a newspaper published in the County of Butte, State of California.
