CZearing, exca:vation, grading, pavzng and installation of a sys~em of domestic water supp].y includi.ng ~ire hyd?-ants, valves, services and al.l o-~he~ i.mpxovements and appur~enances necessary ~or a camp~.ete scheme of domestic wat~~ su~gly facilities ~aithin th~ boar_daries o~ said proposed dis~rict. Excepting tram the area shown and delineated on saa.d map o~ ,~ hereinabove refer~ed to, the area of al1 public streets, avenues, lan~s, roads, dxives, ca~rts, places, public parks, and a1Z ~asements and ~?ights- of-way ther~in contained belonging to the public, and also a11 prope'~rty owned by the County of Butte, the State of Cali~ornia, or the Unite States of Ainerica, contained therein, now in use in the p~rformancelo~ a gub].ic function. NOTICE ZS HEREBY GTVEN that serial bonds to represent un assessments, and beari.ng interest at the rate of not to exceed eigh per cent (8%) per anx~uz~t shall be 15511C'.d in the manner and form proviJded in Part 5, Da~vision 7 af the S~.~eets and H~ghways Code o~ the State of California {~mprovement Act of 1911} to represent ~npaid assessments~ af Fifty Dollars ($50.00) or over, the l.ast installment of which bonds shaJ.l mature fou~teer~ (14} years from the 2nd day o~ January next succeed'ng the next September ].st follawing th~ir date. Said bonds shall be p~y- able to bearer, and may be rede~med as prova,ded in the Tmprovement Act of 1911, and th~re shal~. be added to the redemption clause in said bonds the fo1.l.awing wards: "..,toge~her with a premium of five per cent (5$) of the unmatured principal." In case of default, there sha3.I be added to the defaulted amo;xnt one per cent (l~) of ~he amount thereot, ar~d on the lst day each month followzng sueh defaul~ th~re shall. be added a further -3- penalty of one per c~nt (lg) o~ such d~faulted amount. The one per c~nt (1$) penalty firs~ imposed sha11 be reta~ned by the Treasurer as a cost o~ serv~cing the delinquency and a1I subsequen~ penalties sha11 b~ paid to ~he holder of the bona along wi~h and as a part af s~ch defaulted paym~nt. Proceedings for a~l wo~k shall be taken pu~suant to ~he Municipal Improvement Ac~ ot 1913, and the bonds here~nabove described ~ shall be issued unde~ the provisions o~ ~he Tmprovemen~ Act of 19~~, as h~reto~ore described. BE IT FURTHER RESOLVED that in accordance with the provisions of S~c~ians ~0203 and 10204 0~ the S~ree~s and Highways Code, being a par~ a£ the Municipal Tmprovement Ac~ of 19~3, ~he matter of the impravements arid acquis~tions herein re~erred ~o is h~reby xeferr~d to the Directa~ of Public Works of ~he County of But~e, the person having chaxge and contrQ~ of the improvements a~d acquisitzons descrzbed in this resolution. Said persan is her~by directed to make and file with the County Clerk ot the Caunty of But~e, a report in wri~~ing containing the following: a. Plans and speci£icat~ons of the proposed improve- ment if the improveme~t is not already insta~led; b. A general description of the works ~r app~iances already installed and any other property nec~ssary or convenient for the operation of the improvement, if the °~orks, appliancss or p~operty are to be acquired as part of the improvement; ce An estimate of the cost of the improvemen~ and of the cost o£ ~ands, rights-af-way, easements and incidental expenses ~n connect~on with the improve- ment; d. A diaqram showing the assessment district and the boundaries and dimensions o~ the subdivisions af land w~thin the district as they existed at the time of the passage of the resolution o~ 3ntention. W4_ . , Each subdivision, including each separate condominium interes~ as defined in Section 7$3 of the C~.vil Code, shall be given a separate ~ number upan the diagram;. ~ e. A proposed assessznent of the ~otal ampunt of the cost and expenses of the propos~d improvement upon the several subdi,crisions of land in th~ district in proportian to the estimated benefits ta be received by such subdivisions, respec~ively, from the iinprove- men~. When any po~tion o~ pe~cen~age o~ ~he cost a~td expenses of the iznpxovement is ordered to be paid out ~ of the treasury o~ the municipality, purs~ant to Section 1020I, the amount o~ such portion or percen~~- age sha~l first be d~ducted ~rom ~he total es-~imated cost and expenses of ~he improveanent, and the assess- ment upon property proposed in the re~port shalZ include only the remai.nder o~ the estimated cos~ and exp~n5es. The assessmen~ shall re~er to the subdi~visions by their respective nurnbers as assigned p~rsuant to subdivision (d} of this sec~ion. BE IT FURTHER RESOLVED f.hat if any surpI.us remains in th~ improvement ~und after the completion o~ the impxovements and ~he pay- ment of all claims from ~the improvement fund, said surplus sha11 be dis- t~ibu~ed in accoxdance with Section ~0427 af the Streets and Highways Code. BE IT FURTHER RESOLVED that it is the a.ntentian o~ said County o~ Butte to enter a.nto an agreemeri~ with De~. O~o ~~Tater Coznpany under ~.he ~erms af which the County of But~e will convey to the Del Oro Water Company a system af water distribu~ion facil.ities in accordance with the pro~risions o~' Section 10I.09-10I~1 ~ a.nclusive, of the 5tree~s and Highways Code of the State o~' Cal.ifornia.
