and Ordinance No. 1271 have amended the terms and conditions for
State TV Cab1e operation of cable television :within the City o~
Chico; and
WHEREAS, this Soard has previously imposed the same
conditions for its business license and nonexclusive fr.anchise as
imposed by the City of Chico.
NOT, ~,'H~REFORE, BE IT RESOLVED:
I. Th.at the business license an.d nonexclusive franchise
presently held by State TV Cable, Iric. is hereby amended as provided
in the City of Chico Resolution No. 113 77-78, attached k~.ereto
and incorporated herein as if set forth in fuJ.l, and Ordinance
No. 127I, attached hereto and incorporated hereizz as if set forGh
in fu11. ~lherever the term "City of Chico" appears ~aith~.n tk~e
attactted Resolution and Ordinance, it sha11 be deemed for the purpose
oE this resolution to be "Caunty of Butte." Whe~ever the term
"City Council" appears in the attached 3~esolution and O~dinan.ce,
it shall be deemed ~or,.;~he purpose of this resolution to be "Board
of Supervisors."
2. Tt~at the area in which the business license and
nonexclusive franchise covers withi.n. the unincarpora~ed areas of
the County of Sutte shall remazn the same as previously granted.
3. A11 references made to the Chico Municipal Code in
the attached Ozdiz~ance shall be deemed to apply in the unincorporated
areas covered by the business license and nonexclusive ~ranchise
granted herein.
4. The remainder af t~e terms and conditzons set out in
tlze business license and nonexcluszve ~ranchise granted to State
Cab1e TV ~edecessor and as amended, sha~1 conti~ue in full force and
effect e~cept as amended by virtue of the attached Resolutzon and
Oxd~nance.

VI. COPYRT&HT LIABI~ITY FEES_:

~ed~ral authority, State TV Cable shall ~ave the right to increase ~
its rates fa~ reguiar subscri~er s~rvice to of~set such Ziabiiity. ~
Any increase so made sha~l be lim~ted to the amo~n~ a~ ~iabili~y impased.
• B. Na later than concurrently with the customer bill~ng on which a copyr~ght
liab~lity fee of~set charge ~irs~ appears, S~ate TV Cable shall in~orm
each subscriber as ta the nature arid apprax~mate amount af t~e month~y
offset c~arge. Further, Sta~e 7V Cab7e sh~li arrange to carry ~he
monthly offset charge as a separa~e des~g~ated ~ine item on its c~s-
tomer bi7ling sheet.
C. The City Caunc~l reserves the righ~ to rev~ew the flffset charge at any
~ime and to~make any adjustments ta such o~~se~ c~arge as it cons~ders
appropria~e. .
VIII. EFFECTIV~ DATE:
This fee schedule shall become effective on ~ebruary 2, 1978. Fees approved
pursuant to Reso3u~~on No. 133 73-74 adop~ed Apri] 2, 1974, shali remai~ ~~
effec~ ~hrough February ~, 1978.
