WHEREAS, the Board of Supervisors of th~ County of Butte
finds it to be in the interest of the county to amend the
Personne~ Rules.
NOW, THEREFORE, BE IT RESOLVED, that the Board of Supervisors
of the County o~ Butte hereby amends Section 2:38 of the Personnel
Rules of the County of Butte ~o read as follows:
2.38 MANAGEMENT COUNCIL
An organization composed of county depaxtment heads
includfng elected of£icials and appointed of~icials.
The management council shall~,:meet upon call by the
Administrative Of~zcer. When necessary for the
oraerly and efficient conduct of county busxness,
expenses for council meetings, inc~uding, but not
limited to, meals, travel, and training costs,
shall be apprnved by the~`.Administxative 0£~zcer and
shall be charged to the Adminis~ratiive Office budget
unit.
NOW, BE IT FURTHER RESOLVED, tihat the Board of Supervisors
of the County of Butte hereby amends Sec~ion 2.39 of the Personne~
Rules of the County of Butte to read as follows:
2.39 MANAGEMENT EMPLOYE~
An employee having responsibility for advising,
formulating, administering or managing the
implementation of county policies or programs or
performing professiona~ servzces for the county
(~c,e. Attorneys and Doctors).
NOW, BE TT FURTHER R~SO~VE-, that the Board of Supervisors
of the County of Butte hexeby amends Section 2.59 of the Personnel
Rules of the County of Butte to read as fo~lows:
2.59 SUFERVISORY ~MPLOYEE
Any employee, regardless of job description, regularly
having authority in the interest of the county to
hire, transfer, suspend, lay off, recall, promote,
discharge, assign, evaluate, or discipline other
employees or the responsibility to assign work to
and direct them or to adjust their grievances or
effectively recommend such action, if, in connection with
the foregoing functions, the exercise of such authority
is not merely routine or clerical natu"r.~, but requires
the use of independent judgment.
RESOLUTTON AMENDING THE
BUTTE COUNTY PERSONNEL RULES
NOW, BE IT' FURT}~ER RESOLVED, that the Board o~ Supervisors
of tlie County of Butte hereby amends Section 7.12 0~ the Personnel
Rules of the County of Butte to read as follows:
Z.12 MEDICAL DEMOTION, TRANSFER, TERMINATZON OR RETIREMENT
The appointing authority may require an employee to
subrnit to a medical examination by a physician or
physicians designated by the Personne~ Director to
evaluate the capacity of the employee to pertorm the work
of the position. When such a requirement is made of an
employee, fe~s for the examination shall be paid by the
county. N}~en the appointing authority after considering
the conclusions of the medical examznation provided for
by this section or medical reports from the employee's
physician and other pertinent information, finds a
medicai cause that tlie employee is unable to perform the
work of tlie present class of position, but is qualified
and able to perform the woxk o£ another class of posirion
of less capacity, the appointing authority may, with the
approval of the Personnel Director, demote or ~ransfer
the emp~oyee to such an available position in the depaxtment.
tiVhen the appoanting authority finds a medical cause
exists and the employee is unable to perform the work
of the present position, ox any other available position
in the department, the employee may be terminated. All
original copies of inedical reports, findings, and
informa~ion shaZl be submitted by the appointing authority
to th~ Personne? birector to be placed in the employee's
file.
The Personnel Director shall make detexminations under

safety members. The Personnel Director sha11 certify

the Public Employees' Retirement System. The Personnel

NOW, BE IT FURTHER RESOLVED, that the Board of Supervisors
of the County of Butte hereby amends Section 6.4 of the Pexsonnel
Rules o~ the County of Butte to read as follows:
6.4 PROMOTTONAL AND OPEN EXAMINATION PROCESS
The Personnel Director may announce and hold.promotional
or open examinations for the purposes of establishing
promotional or open eligible lists on a departmental,
county-wide basis or open basis. Competitive examinations
shall be he~d when there are more than (5) five qualified
and eligible applicants for any examination. The Personnel
Directar may waive the examination process when there are
(5) ~ive or less qualified and eligible applicants for
any examination.
NOW, SE IT FURTHER RESOLVED, that the Board of Supervisors
of the County of Butte hereby amends Sectiion 7.2 of tihe Personnel
Rules of the Caunty af Butte to read as follows:
7.2 PROBATIONARY PERIOD OF NEW EMP~OYEES
All new regular employees shall serve a(6) six month
probationary period except that employees appointed to
the c~assification of Deputy Sheriff shall serve a(12)
twelve month probationary period.. Employees appointed
to positions of Jailer and Bailiff afrer October 1, 1977,
sha11 serve a(1) one year probationary period. During
the probationary period the appointing au~hority shall
observe the employee's performance. If the appointing
authority rejects the emplnyee ati any time during the
probationary period, the appointing authority shall, in
writing, infarm the employee and the Personnel Director.
The employee sha11 then be terminated. Employees shali
have no xight to appeal a rejection during the
probationary periad. Tf, at the end of the probatianary
perzod, the appointing authority believes the e~ployee
is performing sa~isfactorily, the appointing authority
shall, ~n writzng, inform the employee and the Personnel
Direcror and the employee sha11 be granted permanent
status and may enjoy such privileges which are set forth
in these rules~ Should the appoin~ing authority fail to
perform the emp~oyee's probationary review at ~he end
of the probatiionary period, the employee shall automatically
be granted pexmanent status. A provisional employee, in
a class who is subsequently appointed to that class as a
probationaxy employee without break in service, shall
have the time sexved as a provisional employee applied to
fulfillment o~ the requixed probationary period.
NOW, BE IT PURTHER RESD~VED, that the Board of Supervisors
of the County of Butte hereby amends Section 7.5 of the Personnel
Ru1es of the County o~ Butte to read as follows:
7_5 HOURS OF WORK
c. The normal woxk period shall be (80) eighty hours
per bi-weekly pay pexxod for each full time county

NOW, BE IT FURTHER RESOLVED, that the Board of Supervisors
of the County of Butte hereby amends Section 7.12 of the Pexsonnel

of the County of Butte hereby amends Section 9.1 of the Personnel
Rules of the County of Butte to read as £ol~ows:
9.i COMPOSTTION qF APPEALS COMMISSION
b. The Commission sha11 be appointed by the Board and shalX
consist o£ (5) five members and ~2) two altexnates.
Nominations to the Soard for Commission appointments
shall b.e made in the fol~o~ing mannex: (2) two
memb.ers and (1) one alternate nominated by the
management council, (2) two members and (1) one
alternate nominated by mutual agreement of the
recognized employee organizations in the county.
It sha11 be the responsibility of the employee
organizations to establish their own pxocedures to
resolve the nomination issue when mutual agxeement
canno~ be reached. The (4) ~our membex nominees shall
nominate a fifth member by mutual consent. If
agreement cannat be reached on this member, each
nominee sh.a11 submit a name to the Clexk of the
Commission and the nomination shall be made through
the efforts of the State Conciliatzon Service. Any
costs incurred shall be divided one~half ~o tihe
county and one-hal~ to the recognzzed employee
organizations involved.
c. The first commission shall classify its members by
1ot, such that ~2} two shaZl serve for a term not to
exceed ~2) two years; (2) two shall serve for a term
not to exceed (3) three years; and (1) one shall serve
for a term not to excee~ ~4) foux years. At the
expiration of each term, as so provided, a successor
sha11 be nominated by the authority which nominated
the member whose position has become vacanti, whether
by expiration of term or otherwise. Appointiees
appointed to complete a term sha11 serve the time
remaining on that term.All appointees appointed to
serve a new term sha11 serve for [4) foux years.
A~ternate members shall be appointed tio a(2) two
year term. 'The Commission shall, at its firs~ meeting,
and annualZy thereafter, on or before ~anuary 30th,
select [1) one of its regular membexs to act as
Chairman and another ~o act as Vice-Chairman.

NOW, BE IT FURTHER RESOLVE-, that the Board o£ Supervisors
of the County of Butte hereby amends Section 10.5 of the Personnel
Rules of the County o~ Butte tv read as fol~ows:
10.5 REIMBURSEMENT FOR EMPLOX~E PERSONAL PROPERTY LOSS
a. The County o£ Bu~te shall provide payment o£ the
costs of replacing or repairing property or prostheses
o~ an.;employee necessarily worn, used, or carried by
the employee when such items are lost or damaged in the
line of duty. Payment of claims under such coverage
sha11 not be appealable under the grievance procedure.
b. The County o~ Butte sha11 no~ provide reimbursement £or
damages to an employee's personal vehicle used on county
business. Reimbnrsement £or the use of an employee's
private vehicle on county bus~ness is provided for in
these rules. Such mileage rezmbursement includes
maintenance, repair, and insuxance costs.
c. The Safety Officer shall approve ox deny the claim
based on the following reimbursement schedule and shall
establish procedures to verify claims and notify the
claimant of the decision:
l. Reimbursement for trades or crafts tools will be
at fuli comparable replacement value and shall be
limited to those items which appear on a written
inventory of tools require@ by the appointing
authority to be supplied by the employee for use
in work. For each incident, a deductible for $50
(fifty dollars) shall be applied to each employee's
~ass.
If stolen tools are recov~red in an undamaged
condition and replacement tools have been secured,
the employee shall return to the countiy the
replacement tools. When the replacement tools are
retuxned to the county, the employee shall receive
fxom the county a$50 cash re~und in consideration
of the $50 deductible. If repZacement tools have
not been secured, the employee shall return all
reimbursement funds received from the county.
2. Rezmbursement for personal prostheses such as
hearing aids or corrective lenses, wil~ be at
compaxable replacement cost of such items damaged
beyond repair and the repair cost of items that
are repaixable. The amount of reimbursement shall
not include the cost of fittings or examinations.
3. Jewelxy items do not come within the definition of
property as set forth in the Government Code.
fiherefore, no reimbursement wi1l be made for
damaged or lost jewelry items. Reimbursement for
damaged or lost w~tches is limited to the functional
value of fhe watch, not to exceed $70 (seventy
dollars).
4. The amount of xeimbursement for damaged articles of
clothing wi11 be determined by the ~ollowing
formula based on the comparable replacement cost,
the age, the Iife expectancy, and the condition o£
the damaged article:

reimbursement is made may be required to be surrendered
to the appointing authority, and shall be disposed of
in a manner approved by the Purchasing Agent.
e. The appointing authority shall conduct a complete
xnvestigation o~ the incident and damage ta include
interviewi.ng claimant and any witnesses, inspecting
damaged property when applicable, and evaluating the
condition of the article in accordance wa.th the 5a£ety
Officer's reimbursement schedule. Based on the
investigation, the appointing authori~y shall in
writing, recommend whether the claim should be approved,
denied, or modified.

charged to the department to which the employee was

g. No reimbursement is authorized for loss or damage
primarily attributable to the claimant's own
negligence or to normal wear and tear or for claims
filed after 30 days of the loss or damage or the
employee's knowledge of such loss or damage.
NOW, BE TT FURTHER RESOLVED, tha~ the Board of Supervisors
of the County of Butte hereby amends Section 11.7 of the Personnel
Ru1es of the County of Butte to xead as follows:
11.7 POLICY AND STANDARDS FOR DETERMINATION OF APPROPRIATE
UNITS
The policy objectives in determining the appropriateness
of units shal~ be the e££ect of a proposed unit on the
efficient operations of the county and its campatibility
with the primary responsibility o~ the county and its
employees to effectively and economically sexve the public,
and providing emplayees with effective representation
based on recognized community of interest considerations.
These policy objectives require that the appropriate unit
shall he the broadest feasible grouping of positions
that share an identifiable community of interest. Factors
to be considered shall be:
a. Similarity o~ the general kinds of work performed,
types of qualifications required, and the genexal
woxking conditions.
b. History of representation in the county and similar
emp~oyment; except however, that no unit shall be
deemed to be an appropxiate unit soiely on the
basis of the extent to which employees in the
proposed unit have organized.
c. Consis~ency with the organizational patterns of
the county,
d. Number of employees and classifications, and the
e£fect on ~he administxation of employer-employee
relationship of dividing a single or related
classificatzon: among two or more units.
Notwithstanding the foregoing provisions of these rules,
each appointed department head as designed in the salary
ordinance, shall be excluded from representation in any
unit; a11 other management, confidential and supervisory
employees shall be included in a unit consistingsolely of
managemen~, confidential and supervisory employees.
The Employee Relations Officer shall, aftex notice to and
consultation with affected employee organizations, allocate
new classifications or posxtions, delete eliminated
ciassifications or positions from units, in accordance with
the provisions of this section.
NOW, BE IT FURTHER RESOLVED, that the Board of Supervisors
of the County of Butte hereby amends Section 12.9 of the Personnel
Rules of ~he County of Sutte to read as follows:

12.9 LATERAL TRANSFER
A regular employee may, upon recommendation of the
appointing authority(s) and approval by the Personnel
Director, laterally transfer to a position having the
sa~ae salary range as that held by the employee and for
which the employee meets the minimum qualifications.
An emplayee Iaterally transferred shall maintain the
same merit advancement date and shall receive the same
salary rate that employee would otherwise be ~ntitled
to on the date of the transfer. A probationary employee
must complete the probationary period in the lateral
transfer class.
NOW, BE IT FURTHER RESOLVED, that the Board of Supervisors
of the County af Butte hereby amends Section 12.10 of the Personnel
Ru].es of the County of Butte to read as follows:
12.10 VOLUNTARY DEMOTION
A regular employee, who upon recommendation of the
appointing au~hority and approval by the Personnel Directox,
voJ.untarily demotes to a position having a Iower salary
range than that held by the employee and for which the
emp~oyee meets the minimum qualifications, sha11 receive
the same sa].ary rate the employee would otherwise be
entitled to on tihe date the voluntary demotion is effective
ar the nearest 7.ower applicable rate. A probationary
employee must complete the probationary period in the
demotion class.
NOW, BE ZT FURTHER 1tESOLVED, that the Board of Supervisors
of the County of Butte hereby amends Section 12.I4 j of the Personnel
Rules of the County of Butte to read as follows:
12.14 OVERTTME
j. Exempt Employees
The overtime provisions of this section shall
not apply to management, confidential or
supervisory positions as defi.ned in these
rules.
Except as provi.ded, an incumbent in a position
defined as management, confidential or supervisory,
shall receive administrative leave in lieu of
pai.d overtime. Administrative leave in-lieu of
paid ov'ertime shall be accumulated at a rate of
0.1~54 days per bi-weekly period of compensa~ed
service for the period December 24, 1977
thxough December 27, 1978, and 0.1538 days for
each bi-weekly period of compensated service
th.exeafter. Administrative leave may be
accumulated ~eo a maximum of 20 days. Emp~oyees
who terminate from the county in good stianding
shall be compensated for any admini.stirative
leave accrued under this section, up to the
maximum accrued amount.
Incumbents in positions defined as management,
confidenta.al or supervisory, who pxior to
December 24, 1977, were eligible fox tihe paid
overtime provisions o~ these rules, sha11

continue to be e1~g~ble to receive overtime pay
or compensatory time. Such incumbent may, through
written mutual agreemen~ with the appointing
authority and approval o£ the Personnel Director,
convext from the overtime provisions of these
rules to the in-lieu adminzstxat~ve ieave provisions.
Once such agreement xs reached, it shall not be
reversible for the position. Whenever a management,
confidential or supervisory position, ~or which the
compensated overtiime provisions apply becomes
vacant, the position shall be identified as one to
receive administratzve leave in-lieu of ovext~me
before the position is refilled. Whenever a new
management, confzdential ox supexvisory position is
created or designated pursuant to these rules, ft
shall be exempt from overt~me provisions af these
rules and the in-1~eu administra~ive Ieave practices
Sna11 apply to the pasition.
NOW, BE IT FURTHER RESOLVED, ~hat the Board o£ Supervisors
of the County of Bu~te hereby amends Section 13.5 of the Personnel
Ru1es of the County of Butte to read as follows:
13.5 HOLIDAY LEA
a) Designated Holidays. Each regular employee in a
compensated employment status on the assigned work
day immediately preceding and the assigned work day
immediately following a designated holiday, shall
be ~ntitled to compensation for the designated
holiday. The following holidays are designated:
1) New Year's Day January 1
2) Lineoln`s Birthda.y February 12
3) Washington's Bir~hday Third Monday in February
4) Memorial Day Last Monda.y in May
5) Independen~e Day Ju1y 4
6) Labor Day First Monday i.n September
7) Admission Day September 9
8) Veterans Day November 11
9) Thanksgiving Day Designated Thursday in November
10) Christmas Day December 25
11) ~ery day appointed by the President or Goverrnox for a
public fast, thazilcsgiving, or holiday.
When a designated holiday faT1s on Sunday, the
following Monday sha11 be observed. When Veterans
Day falls on Saturday, the preceding Fri.day shall
be ohserved. A regular employee reQui.red to work
on a designated holiday or whose regulax scheduled.
day off fa11s on a designated holiday shall at
the descretion of the appointing authori~y be
entitled to either equivalent compensated time off
scheduled the day preceding the designated holiday
or within {60) sixty days following the designated
holiday or equivalent compensation to be paid
within (60) sixty days fol~owing the designated
holiday.
Regular employees exempt from paid overtime shall
he entitled to compensati.on fox designated holidays
actually worked. Extra help employees shall not
be en'titled to paid holidays or compensated time
aff for holidays worked.

b) Personal Holidags. In addition to the designated
holidays each regular employee shall be entitled
up to (3) three persona~ holidays per calendar
year. Regular employees, employed as of Januaxy 1
of each~year shall be credited with ~3) three work
days o£ personal holidays. Employees hired between
January 1 and Apri1 30 sha11 be credited with
(2) ~wa work days of personal holidays for the
remainder of the calendar year. Employees hired
be~ween May 1 and August 31 shall be credited
with (1) one work day of personal holiday for the
remainder of the calendar year. Employees hired
between September 1 and December 31 shall receive
no personal holiday credits for the calendar year
during which they were hired. No employee sha11
r~ceive more than (3) three personal holidays in
any calendar year. An appointing authority may
require an employee to provide (14) fourteen days
notice in advanc~ of the personal haliday. In the
event of an emergency an appointing authority may
deny the employee's personal holiday. Personal
holidays sha11 be sch~duled and taken off within
thE calendar year to which they are credited.
Employees sha~1 nofi be compensated in pay fox
personal holidays in lieu of time off.
NOW, BE IT FURTHBR RESOLVED, that the Board of Supervisoxs
of the County of Butte hereby amends Section 13.9 of the Personnel
Rules of the County of Butte to read as follows:
13.9 HEALTH INSURANCE
AI1 county officers and regular employees assigned to a
(I/2} ane-half time or more position and the employees'
dependents shall be entitled to participate in the county-
sponsored gr:.oup health ~nsur.ance program. Eligible
employees enroll~ng in the program within (30) ~hir~y days
following their appointment will be insured subject to the
contract limitation with the insurance carrier. Employees
enrolling after the (30) thirty-day enrollment period
wi~~ be approved only upon evidence of insurability.
Regular employees assigned less than (1/2) one-~alf time
and extra help employees shall not be elagible for
partfcipation in the health insurance program.
Employees sha~l pay (10%) ten percent of the total monthly
prem3um for employee and dependent coverage to be paid
through a payroll deduction unless otherwise specified
in this section~ To be eligible for premium sharing, an
employee must have no less than the total of (10) ten days
of compensated employment occurring within the (2) two
regular pay periods immediately preceding the pay per•iod

~mployees with less than the required compensated days
of employment may continue coverage by advancing to the
Auditox the total premium amount £or the month. ~or the
purpose of this section only, an employee on an approved
industrial disability leave of absence, who is receiving
temporary disability payments from the compensation
insurance fund shall be considered in full compensated
employment status. An insured employee granted a non-
compensated Zimited leave of absence may continue heaith
insurance coverage by advising the Personnel Director and
advancing to the Auditor each month, the total monthly
premium cost.

Employees who retire under the provisions of the county's
Re~irement Contract with rhe Public Employees' Retirement
System (~ERS) may contiinue to insuxe themselves and
thezr ~nsured dependents for the basic heaZth and
catastrophic insurance by advising the Personnel Dixector
and advancing the full pxemzum for insurance coverage in
a manner prescribed by the Personnel Dixector.
