That the district benefited by said improvements and acquisitions and to b~ a~sessed ta pay tha costs and ~xpenses ~here- af, is more particularly d~sczibed in the Reso~u~ian o~ Intention, hereinabove referre~ ~o and made a part hereo~ by reference ~h~reto. Sa3d Resolutian of Intention also~excepts fro~ th~ district ~o be ~enefit~d the area of a~~ pub~ic str~~~s, avenu~s, lan~s, roads, drives, co~rts, places, public parks, and all easements and rights- af-way therein contained be~onging to the public, and also all pro~ p~rty owned by the County of Butte, the Sta~e of Califo~nia or the United States of America, contained therein, now in use_in th~ per- ~ormance of a public function. 2. Tha~ the Estimate o~ Cost of th~ itemized and to~al estimated cast and expenses o~ the impravemen~s and acquisitions, and af ~he incidental expenses in connection ~herewith, is on file w~th the County Cl~rk o~ the County of Butte in the Amended Engineer's Repo~t, and it is he~eby ~ina~~y adop~ed and approved as the Engi~eer's tatal and detailed est~mate of the cost and expenses of said improv~- ments and acquisitions. 4. That the work and improv~m~nts to be made, as described in ~he Resol~tion of ~nten~ion, and ~he Amended Engineer's Repor~ on file with the County Clerk o~ the County of Butte are hereby approved, and a11 of the matters contain~d in said Amended Engineex's Report are approved and con~irmed. The Board o~ Supexvisars o~ ~he County of Butte further finds that the public convenience and in~eres~ xequire, and hereby orders ~he impronemen~s ta b~ mad~ as described in and ~n accordance with said Resolution of Inten~ion, and said Amended Engi~eer's Report. Reference to both ~he Resolu~ion of Tntention, and the Amended Engineer's Report as hereby made for a mo~e parti- cular description of the work and ~mprovements herein approved, con- ~irmed and o~der~d. 5. That the amoun~ ~o be assessed against each o~ the parcels or subd~visions of land .shown on ~he Amended Engineer's Report does not exceed 7~4 of the market val~e o~ each of the properties assessed atter the construction of ~mpravements; ~ha~ the appraisal of th~ market value Qf ~he properties to be assessed on ~i1~ in these pro- ceedings is hereby adopted as.the marke~ value ~of each of said ~ parcels. ~ -3- 6. Th~ Board of Supexvisors o~ the County o~ But~e does hereby levy and appo~t~an upon each and every 1at, pi~ce and pa~ce~ o~ land within the baundar~es o~ the assessm~n~ distr~ct the amo~nt by which each of said lots, pieces o~ parce~s of land is benefited by the improvements and acquisitions. The amount of the assess- ment which is levied and apportioned upon each and every Iot, piece and parce~ o~ ~and within ~he boundaries of the ass~ssm~n~ district is as shown on the assessment at~ached to and made a part o~ ~he Amended Engineer's Report adopted by this resolution. Th~ Board o~ Supervisors of the County af Butte hereby ~inds and d~~ermines that each o~ said Lots, p.ieces or parcels of land within ~he boundaries of said distric~ is ben~~ited in the amount and in the p~oportian o~ the to~al cos~ of ~he ~mprovements and acquisitions, glus incidental expenses, which each of said lots, pieces or parcels o~ land has been assessed in said Amended Engineer's Report. 7.
