WHEREAS, Article V, Qtapter 20 of the Butte County Ordinance Code relating
ta subdivisions in the County of Butte requirea the establishment of a street
lighti.ng system in new aubdivisfons to be approved in the County of ButCe purauant
to the provieions of safd ArCicZe V, Chapter 20; and
WHEREAS, California Streeta and Highways Code Section 5821.3 provides ehat a
street lightiag maintenance district may be formed or the property annexed to an
existing maintenance diatrict, without notice ox hearing, whea s street lighting
syatem is required to be installed by a subdivider; and
WfiEREAS, on or about sanuary 25, 1977 , a tentative map of the
Shasta Estates Subdivision was approned hy the Subdiviaion Iteview
Committee of the County of Butte requiring among other Chings the instal.lation
of a street lighting system as provided for in Article V Chapter 20 of the Butte
County Ordinance Code; and
WHEREAS, a petition by the Suhdivider, Stephen C. Bur~on,
has been filed wiCh this Board, requesting the formaCion of a street lighting
maintenance district undor the ~lTOY1.S~OhB of the Improvement Act o£ 14Z1 ((~apter 26,
Part 3, Aivision 7, Section 5820 et seq.); and
WHEREAS, public interest and convenience require tFte formation of a street
iighting maintenance diatrict herefnafter referred to as Shasta Estates
Lighting Maintenance Distra.et for the purpose of defraying the expensea,
maintenance and operation of an electrical atreet ligt~ting syskem. Said system
will consist of poles, kssghts, posts, wirea, lamps, and other necessary equipmeat
installed in the hereinafter described unincorporated territory of the County of
8utte, State of Calffornia. Said syetem is to be located on and will light portfone

of public ways in said street lfght#ng maintenance diatrict. The lfghting syatem
that will be operated and maiatained consfsts af overhead service street lights
which are suspended over the streets from brackets or arms fastened to poles; and
WHEREAS, the aperation of the lighting system shall consist o£ supplying the
lamps with electric energy for all night burning and switchiag Chem on and off
once each night in accordance with standard switching schedules approved by the
Public Utilities Commission of Che State of California. Maintenance shall cansiat
of replacing the lampa when they burn out and of keeping the system in good operating
order; and
WHEREAS, this Baard of Supervisors does hereby determine and declare Chat
the e~cpenses of maintainfng and operating said atreet lighting system herein
described will be asseased upoa the landa lying ~iChin the said atree[ lighting
maintenance diatrfct, that the monthly rates charged for said street lights sha1Z
be in accordaace with ffled schedu~ea appraved by the Public Utilities Ca~nission
of the S~ate of Californie; and
'WHEREAS, all of said Lands lying withfn satd street lighting mafntenance
district will be bene£ited by the maintenance and operation of said sCreet
lighting system. The territory within said street lighting mainte~ance district
is aiCUated in the County of Butte, State o£ California, and is more partiicularly
described hereinbelow.
NOW, THEREFOR~, BE IT R~~OLVED BY THE BOARD OF SUPERVISORS OF TtiE COUNTY OF
BUTTE, STATE OF CALIPORNIA, that a street lighting maintenance distxict under the
pzovisions of Che Improvement Ack o£ 39i1, Chap~er 26, Part 3, Aivision 7 of the
Streets and Highways Code of the State of Cali£ornia is hereby formed and created.
BE IT FURTHER RESOLVED that the name of said street iighting maintenance .
distx~ct sha12 be Shasta Estates Zighting Maintenanee District. . .
SE IT FURTHER RESOLVED that the terrftory wiChin said above na~ed street
lighting maintenance district is situated in the Connty of Butke, State of
~ California, and more particularly described in ~xhibit "A" attached hereto and
made a paxk hereof by this referenceo
