WHEREAS, We~fa~e fraud is a crime in ~h~ S~ate of California
~to be p~osecu~ed by ~h~ co-un~y dis~rict attorn.eys thx~ough the cou~t
sys~em; and
WHEREAS, ~he infozmati.on ~athered in ~he investigation
process is o~ c~iminal na~ure in. WeZ.fa~e fraud cases :~. ..
NOLJ, THEREFORE, ~E IT RESOLVED as faZ.lows:
1. That th~.s Board strongly opposes r~gulations that
wot~.ld violate an individual's and ~he Peaple's righ~ to due process
o~ law, and fur~her sugges~s that the adzni.ni.strati.on.'s propos.ed
regia.lati.ons are, ~.x~. fact, an obstxuction of j-u.s~ice.
2. That ~his Board would suggest to the adFZ-in.~.stration
of the State that WeZfare ~raud is a crime rahich should b~ ~reated
as ax~.y other c~ime, w~.th a1.1 the attex~.daxzt pxotection of due pxocess
of laca ~or the individua~ conce~ned, and ~or the People o~ the State
of Ga~.ifornia.
