F~LING FEES FOR SiJBDIV'IS~OiV'S WHICIi ~RF
II~ EXCESS OF` ACTU.i~dZ PROCESSIIVG COSTS
WI~REAS, the Board of Supervisors by the adopta.on of
Resolutions 76-'19'i, 77-5, 77-63 and 78-89 has established f ees for
the processing of initial review o~ enviror~menta]. effects o~ pro-
jects as progided ~or in the California Environmental. Quality :~ct
o~' '1970 ( CEQ~A ) ; and
WHEREAS, it is the intent o~ the Board that in so far as
possible, the fi~.ing fees should reflect actual costs of admini-
s~ration and preparation as determined pursuant to Resolu~ion 78-
89; and
WTIII-tEii~,S, ~'or some subdivision projects the filing fee
has far exceeded the actual costs of preparation and administration
o~ the initial review.
NOW, THERg'ORE, BE IT RESOLV~ED b~ the Board o~ Supervisors
of the County o~ Butte, State o~ Cal.ifornia, that the second to the
Zast paragraph o~ Aesolu~ion `~8-89 be amended to read as follows:
"~n the case of subdivisions, when an environmental
impact repo~t is required, ax~y amount of the ~ee de-
posited ~or ini~tial re~view no~ ~et expended, shall be
credited towards the preparation and ac~ministration of
the e~a.vironmental impact report. If an enviro~amental
impact repor-~ is not required, or if t~ie costs of the
preparation and administration of the environmental
impact report are less than the filing ~ee collected,
the applicant shall be entitled to a refun.d of that
portion of th.e ~'~.ling fee which exceeds the actual
costs ofi preparation and admin.istration of the environ-
mental impact report, and/or initial review. Such
refund shall only be processed when the azr~ount of such
refund exceeds $25.00."
