HomeMy WebLinkAbout78-118BRENTWOOD STREET LIGHTING N~ZNTENANCE DISTRICT WHEREAS, Article V, Chapter 20 of the Butte County Ordiqance Code relating to subdiviafone in the County of Sutte requires the establishment of a street lighCing system in new aubdivisions to be approved in the County of Butte pursuant to the provisions of said Article V, Chapter 20; and WHEREAS, Califoraia Streets and Highways Code Section 582I.3 provides that a atreet lighting maintenance district may be formed or the property annexed to an exiating mainteaance diatrfct, without noCice or hearing, when a street lighting system is req~ired to be installed bq a aubdivider; and WHEREAS, on or sbout June 27, 1977 ,$ tentative map of the B1~NTWOOD SUBDIVISION was approved by the Subdioiaion Review Committee of the County of Sutte requiring among other things Che installation of a street lighting system as provided £or in Artfcle V Chapter 20 af the Butte County Ordlnance Code; aad WHBREAS, a petition by the Subdivider, ~ ROBERT D. BRYANT has been file& with this Board, requesting the formation of a etreeC 1ighCing maintenance district e,indor.t~e pr•avLe'.a~s of the Improvament~Ac~ of 1911 ((hapter 26, Part 3, Diviaion 7, Section 5820 et seq.); and WHEREAS, pubiic interest and coavenieace require the formation of a street lighting maintenance district hereinafter referred to as BRIIVTW00~ STREET ~SGHT2NG MAINTE;VANCE DTSTRxCT for the purpose of defrayi,ng the expensea, ' maintenance and operation of an electrical street lighting system.
