THE BUTTE COLNTY ENVIRON_^~fEi~TA~, R~VI~CJ GCJID~S~I~iES
WHEREAS, rhis Board has reviewed the Lnvironmental Itevi.ew
Guidelines of the County of Butte as last amended on May 9, 1978,
and has determined that additional amendme~rtts need to be zT.~ade a.n
order to more adequa~eiy Confornt to the spirit as well as the letter
of the California Environmental Qualiry AcC.
i~OW, THEREFORE, BE IT RESOLVED by Chis Soard as folloGrs:
1. That Paragraph 5(S) of the Bu~te GounCy Fn~crironmenCal
Guidelines be amended to read as follo~,rs:
"A hearing on t1~e drafr EIR sha~.l be held
by the decision-making body. All parties
in~eres~ed in the proceedings are s~rongly
encouraged Co submit tt~.eir commen~s on the
dra~t EIR in urri~ing, preferably before
the hearing, but if unabZe to do so<prior
to rhe hearing,_at the hearing itself. Ora1
comments at the hearing sha11 be limited to
five (5) minutes by each person."
2. That Paragraph 5(V) of the Butte County Environmental
Guidelines be amended to read as follows:
"The final EIR sha11 be reviewed and con-
sidered by the decision-making body prior
to approving the project. However, nothing
herein sha11 proliibit a member of the
decision-making body from requesting that the
County Counsel; or his authorized deputy,
prepare proposed findings for his considera-
tion prior to the receipt of the final EI~,
provided further, however, that this request
to the County Counsel, or his authorized
deputy, sha11 not be construed in any way
as a decision on the issue by the x'equesting
member, nor will t~ie requesting member be
bound in. any way whatsoever to the fix~dings ,
etc., prepared by the County Counsel."
