The Local Agency has appropriated a sum of morueq Co pravi.de fire protection
services within Local Agency's terriCoria~ area nf responsibf.l~.ty for the peri.od

indfcated above and tizat the seam of $ 1,246,36~ so appropriated is
budgeted for expenditures as set foxth i.n the attached Schedule{s) A.
The State shal~ make a claim, fox the cost af the services to be rendered
duri.ng each of the fol~.owing periods: (1) Ju].y 1 Chrough Dece~ber 3~; (2) ,Tan-
uary L thrqugh March 3~; and (3) Apxi1 1 thro~gh June 30, the clafm for the period
{1), July 1 through December 31, shal#. be submitted }~y State for acrual expenses
to Local Agency no earlier thaa .Tanuary l, The c~.aim fox the period (2), ,7anuary
~ xhraugh March 31, shall be submitted by State for actual expenses to Lacai Agency
no earlier Chan April 1, and the cl.a~xn ~or the periad {3), April 1 through 3une 30,
sha.ll be submitted by State, in advance far ~sti.mated costs to Loca~ Agancy no
earlier tihan Apr~.l 1 and Loca~. Agency s~a~], pay each claim wi.thin th~rty days after
receipt thereof. A final clairn will be made hy Srate far actual services rendered
by State covering the periocl (3), April 1 through ,7une 34, giving credit ~'ar
advance payment previously receiv8d by State from Local Agency. Zf the advance
paya~ nt received hy State Exam Loca]. Agenty for tne estima.ted cos~s exceeds the
acrual c~a~.m for the periad {3), April 1 through 3une 30, a refund wi}~~ be made
by S~ate and aecomparry the fa.nal claim. The State wi~.l be al].owed reasonab3.e
f lexibi.li.ty in the assigr~menC o~e avail.ahle personnel and eguipmenC i.n arder ta

liabili~y l~.m~.ts of no less than ~500,000.00. Said evidence of ~.msuxa~ace must

and 13Q54, Health and Safety Code, the State inay, an reqnest o€ the Loca1 Agency,
demand payment of charges and s~eFc reimbursament of ~,ocal Agency casts for
persanxLe]. as ~uzXded herein, undar authority given by Sections ].3051, and 13D54,
Health and Safety Code, Tlze Stata, in seekirzg said r~iuabursementi wi~.l represent
~he ~,ocal Agency in following the praceduxes set ~ort1~ in Sectian 13052, Health
and Safety Code. Any recovery, o~ Local. Agency cas~s, ].ess expenses, w~}.1 be

E. Reimbursement tc ~he State may be paid from any tuads bndgete~ without
regard to category and, ff necessary, from any contingency i~em,

Agency at the Office of the Director of Forastrp. For a~y servic~s pexfarmed
direct~.y by the State ar p~ocured by ~he State for the Local Agency, as con~emplated

listed ~.n said Schedules A a~d C, and anp ather vehicle made avai~able by the ~ocal
A$eacy, but not including, S~ate-awned veh~cles, for ti~e performanca af f~.re
protecti.on services under this Agr~ement. A"S~a~e-awned vehic3e" is any vehicle
awaed and registered in the n~ame of the State o~ Cal~.fornia.
