HomeMy WebLinkAbout78-174 No. ~8-~7~ WI~E1tEAS, rhis Board is in receipt of a Resolution dated September 20, 1978, from the Paradise Irrigation District, which Resolution of the Paradise Irrigation District requests that the County advise said irrigation district of the cost involved in the County`s assumption of the assessment and collection duties of the District, all pursuant to the provisions of Chapter 8, Part 10, Division Il of the Water Code of the State of California. WHEREAS, this Board has requested and received from the County Auditor, the County Z'reasurer and County Assessor recommenda- tions as to the charges that would be applicable hereto. NOti~, THEREFORE, BE IT RESOLVED that this Board finds as follows: 1. That the applicable charges as pursuant to Water Code Section 266D3 are as follows: a. The fee charged by the S~ate Board of Equalization to prepare the necessary tax code area maps shall be paid by the 1?aradise .Irrigati.oxz Dis~rict directly to the State ~oard of Equali= zation, and the Paradise Irrigation District shall be responsible for making all necessary filings with the State Board o£ Eq.ual.ization. A fee of $2.50 for each assessor parcel ~hat will require remapping, i.e. where the present assessor parcel would not caincide with the boundaries of the Paradise Irrigation District. c. A charge of $25.00 per parcel for each parcel that wi11 have to be reappraised by the Assessor. d. A one-time cost of $200.00 as Auditor's cost ~or in-put of the necessary coding into the tax roll procedures, including data processing cost. e. Any additional actual expenses, includinQ but not Iimited to annual maintenance of parcel maps and appraisal costs to the Assessor not adequately covered under paragraphs a, b, c, above, caused to the County by virtue of the County assum~ng the aforementioned responsibilities from : the Paradise Irrigation District, it being impossible for this Board to advise Paradise Irrigation District of the actual cost at this time. 2. Delinquent D~strict assessments shall be transferred' to the tax collector of the Coun~y of Butte for collection, ~oiiow- ing which ~hey shall be placed on County tax bills for current payment; with delinquency procedures thereafter to be conducted by said County Tax Collector in the same manner as if the said assess- ments had been fzrst made in the year during which they first appeared on the County ~ax bill. 3. Upon such transfers, Paradise Irrigation District shall extinguish the existing certifica~es of sale pertaining thereto; the Coun~y of Butte sha~1 not be 1iable for payment of such ~ransferred assessments except to the extent they are actual~y collected, and -3- shall not be required to account separately by parcel number for ' such col~ections. 4. Lands subject to sale for unpaid assessments sha11 be sold to the State. 5. The County of Butte shall no~ make any charge f_or collections, unless the Board of Supervisors policy as to not charging all the other districts is changed or modified. In the event the Board of Supervisors so modifies its policy, rhe CounCy sha11 give Paradise Trrigation Dis~rict thirty (30) days notice thereof. 6. That a copy of this Resolution be for~hwi~n sent to the Paradise Irrigation District, Butte County Assessor, Buttie County Treasurer/Tax Collector, Butte County Auditor and ~o ~he State Board of Equalization.
