Z AN INTERIM ORDTNANCE ~'PABLISHING REGULATIONS FOR THE USE OF LAND
AND THE GONSTRUCTTON AND USES OF BUILDINGS W.CTHIN A PORTION OF THE
2 UNINCORPORATED AREA QF THE COUNTX OF BUTTE
3 The Board of Supervisors of the County of .Butte, State of Galiforni ,
4 does ordain as follows:
~ SECTION 1. NECESSITY. The Board of Supervisors finds that
6 certain regulations are necessary for the preservation of the public health,
7 safety, convenience and general welfare, pending the conducting of studios
$ and surveys and the preparation and adoption of a Comprehensive Lsnd Use Plan for
9 the County of Butte, and hereby adopts certain such regulations as urgency measur s
10 of an interim nature as set forth below.
11 SECTION 2. REGULATIONS:
12 2.1 The provisions of this ordinance shall epply to all properties
13 lying within the hereinafter described area, situate in the County of Butte,
14 hate of California, in the community of Chico, California, particularly
15 described as follows:
16 Beginning at the intersection of Cohasset Road and Lupin Avenue,
17 thence easterly along the centerline of Lupin Avenue and its projection easterly
18 to the centerline of Cactus Avenue, thence southerly along the centerline
19 of Cactus Avenue and its projected extension to the centerline of Lindo
2O Channel, thence westerly along the centerline of Lindo Channel to its inter-
21 section with the southerl
y projection of Cohasset Road, thence northerly along
22 the southerly projected centerline of Cohasset Road and along the centerline
23 of Cohasset Road to the point of beginning, excepting therefrom all areas
24 that have already been detail zoned by the Board of Supervisors under County
2S Ordinance No. b22 and land withia the incorporated City of Chico.
26 2.2 Uses Aermitted: The following uses are permitted within
27 all parts of the District:

{a) Lawful uses of land now established.

(b) Dwellings and accessory buildings.

(c) Agricultural uses and buildings.

2.3 Use Permit Required: No new commercial buildings, industrial
32
ses of ].and ar buildings, public or quasi public uses including schools, churches

1 public buildings, public utility buildings will be allowed without first
2 securing a use permit approved by the Planning Cammissian and Board of Super-
3 visors.
4 SECTI(}N 3. ADDITIONAL, B1;GIILATIONS.
5 3.~ The following regulations shall apply in all parts of the
6 District:
7 a. Building Setback Lines Required: No building or structure
8 shall hereafter be located within the District closer than fifty (50) feet
9 from the centerline of existing County road; this section shall pat apply
10 to public utility transmission lines, mains or other transmission facilities.
11 b. Minimum Building Site Required: Each single family resi-
12 Bence shall be located on a site not less than eight thousand, one hundred
13 and twenty-five (8,'125) square feet, and said residence shall be located
14 not less than six (6) feet from the side line of the building site.
15 c. Minimum Building Site Width Required: Sixty five (65) feet.
16 3.2 In cases where compliance with the provisions of this
17 section will result in undue hardship, a variance may be approved in the
l8 manner prescribed for the handling of a use permit.
19 SECTION y,. USA P.tS,RNlITS:
20 L,..1 Application for a IIse Permit sha31 be made to the Butte
21 County Planning Commission and such application shall include a description
22 of the requested use and shall be accompanied by plans showing the location
23 of proposed buildings or proposed alterations, locations of driveways and
24 parking areas, advertising structures and other information as may be required
2S by the Planning Commission.
26 4..2 The findings and recommendations of the Planning Oommission
27 shall b® submitted to the Board of Supervisors.
28 4.3 Any person not satisfied with the final action of the Board
29 of Supervisors may, within ten (10) days thereof, appeal in writing to the
30 Board of Supervisors. A copy of such appeal shall be submitted to the Plan-
31 ping Oommission. Said Board of Supervisors shall render its decision within
32 sixty (60) da~rs after the date of the filing of such appeal.

li..h. Revocation:
A. In any case where the conditions imposed by the Use Permit
have not been complied with, the Planning Commission shall give the permittee
a ten (lO} day notice. Tf, at the end of said ten (10) day period the
permittee still fails or refuses to comply with the previsions of the Use
Permit, the Planning Commission shall have the right to recommend to the
Board of Supervisors that said Use Permit be revoked.
B, In any case where a Use Permit has not been used within one
(l) year after the date of the granting thereof, the Use Permit shall be
automatically null and void.
~..5 The Planning Commission shall hold public hearings as
prescribed by law.
SECTION 5. VIQI,ATIONS:
Any person violating any of the provisions of this Ordinance
is gsilty of a misdemeanor.
SECTION 6, EFgECTTVE DATE:
This ordinance shall take affect immediately upon its passage
and before the expiration of fifteen (15) days after its passag® it shall be
published once with the names of all members voting for and against the
same in the Chico Enterprise-Record, a newspaper published in the County of
Butte.
This ordinane~ shall be of no further force and effect one year
from the date of adoption hereof; prov9.ded however this ordinance may
be extended for one (1) year as provided in Section 6580b of the Government
Code of the State of California.
No more than two (2) such extensions may be adopted.
PASSED AND ADOPTED by the Board of Supervisors of the Gounty of
Butte, State of California on the 17th day of September, 1963 by the following
vote:
