BE IT RESOLVED, pursuant to Butte County Code §21-54,
that Rule 30 Carough Rule 32 of the Assessment Appeals Board for
Butte CounCq is hereby established to read as follows:
RULE 30: Because of the large number of appeals filed for
rhe year I978-79, the Assessment Appeals Board is directed to 1~.oZd
prehearing conferences in order to facilitate the handling of their
business, including setting of hearings and to advise applicants of
their rights and responsibilities relating to their assessment
hearings. Prehearing conferences sha11 be heard before the Chairanan
of the Assessment Appeals Board or by a member of the Assessment
Appeal.s Baard designated by the Chairman. Fifteen (ZS) days notice
sha11 be given of sv.c~ prehearing conference, which notice shall be
given by the C1erk.
RULE 3I. At the prehearing conference, the Chairman or
his designee sha11 review the requirements for the presentation of
evidence before the Assessment Appeals Board, including the type of
testimony that is relevant and necessary for the applicant to present.
Also at ttze prehearing conference, the partzes involved may request
specific dates for their heari.ngs, as we1J. as a determination as
to the length of the hear~.ng can also be made at this time.
RULE 32. Fai~ure o~ an applicant to appear a~ the pre-
hearing conference sha11 be gzounds of dismissai of the application,
provided, however, that where an applicant fails ro appear, the matter
sha11 be set at the prehearing conference for hearing on a specific
date, at which time if applicant fails to appeax, his right to hearin.p,
shall be ~inally dismissed. The Clerk shall set the notice of said
hearing pursuant to Rule 7.
