NOW, THEREFORE, BE IT RESOLVED AND ORDERED BY TbIE BUTTE COUNTY BOARD OF SUPERVISORS, as follows: ' l. Application and a proposal is hereby made to the Local Agency Formation Commission in accordance with the Knox-Nesbit Act~ beginning with Government Code Section 54773, for establishment of County Service Area No. 59• The exterior boundaries of the propased Service Area are described in E~ibit "A" attached hereto and made a part hereof by this reference. 2. Establishmen~ o~ said Service Area is proposed under County Service Area Law (Chapter 2.2; Part 2, Division 2, Title 3 of the Government Code beginning with Section 25210.1). The type of ex~ended service proposed to be provided is street ligh~s. 3. The Clerk of the Board is authorized and directed to file"a certified copy of ~his resolution with the Executive Of£icer of the Butte County Local Agency Formation Commission. We fully understand and appreciate the provisions of Article 13 A of the California Constitution (Pro~osition 13 on the Primary ballot) and, therefore, would recommend that the cost be paid for by us pursuant to Government Code sectior~ 25210.77a. We understand that if the board of supervisors determines to levy an ad valorem tax that a tax rate election will have to be held and should the 6aard elect to pay for the cost thereof by service charges, that there will have to be an annual hearing on the question of spreading the costs as a service charge to the af~ected parcels.
