WHEP~EAS, the provisions of the Ed~.cation Code authorize
~he ~rans~er o~ ~unc~ions from the Butte County Board af S~xpe~va~sox;
to the Butte County Boazc~ of Educa~ion and further au~harize agree-
me~.~ as ~o various aspects e~nanating from the ~xan~~er; and
~~iEREA5 , the B~.t~te County Supex~irz~enden~ af Schools w~l'1
be directly a~fected by ~h~.s transfer and, therefore, his affirma-
tion and accep~ax~.ce of ~he ~erms and conditions of this Reso~ut`ion
and Agreernent are appropriate. ~
NOW, THERF4RE,.BE IT RESOLVED as ~ollows:

un~.ess also adop~ed wi~hout amendment by the Butte County Board of
~ducata.at~. p~iar ~o July 1, 1979, and also un.~.ess agreed to by', the
Butte County Superintei~dent af Schoals.
3. The tunctinns referred to in ~ducation Gode §~~43:are
hereby transferred fram the Butte County ~oaxd o~ S~pexvisors`to
the $utte County Board of Education. `
4. The approval of ~he Bu~~e Co~.n~y Superintendent o~'
School.s' es~ima~e of a~-ticipated r~venu~ and expenditures pursu:an~
ta ~ducation Code §I.U42, et seg. is hexeby transferred ~ram ~h~'
$utte Coun.ty Board,of Supe~v;_sors ~o ~he Bu~~e County Board af
Education, prov~.ded ~ha~ af~er such a~prova:~ it shaZl ~e ~il.ed ~
with the Sutte County Board a.f Supervisor5.

transferred fro~n the Butte Coun~y Board of Su~erv~soxs to ~Che
Butte Caunty ~oaxd of Educatian.

relative to ~he organiza~ion or reorganizati.on of school districts

But~e Coun~y Board af 5upervisors to the Bu~tte County Bnard af `
Education.
7. The ~rans~'er a~.d functians under this Resol.ution sha3.1.
t7.a~ a1~er the requirernent.that the expenses for such duties and
~unc~ions be paid ou~ of ~he Coun~y General. Fund as prov'ided in`
the Education Gode provz.ded, hawever, that the ~utte County ~oa~d
of Supervisors an.d the Butt~ County Soard of Education agree that
a11 or any por~~.on bf the expenses fo~' such duties and function.s
which are by 1aw ~equired o~ pexma~~~ed ~o be paid from the County
~eneral ~'und, shal.l be included in thaC part of ~he s~n~1e budget
prepared by the Bu~te Coun~y Board of ~ducation for which a County
tax is levied pursuant to Education Cade §1b23.
8. As of ~he effective date o~ th~s.R~salutian, those
County employees assigned ~o ~he O~f ice of the Sutte Coun~y
5uperintenden~ of Schools sha~1 be trans~erred to the But~e Cou:nty
Superiz~.~endent of Schoal.s pursuant to the provisions of Education
Code §§1313-1316.

9. Upon comgle~ion of the new county administra~ion
bui~~ing in ~he county center, ~he county offices in the o~d
ad~in~stratian building shall be vaca~ed. A~ 5uch ti~e ~he board
of supervisors a~ree ~o execu~e ~he deed ~hat is attached hereto
as Exhibit "A", which is incorpo~ate~ here~n as if set farth in
fu~l, which deed conveys the prape~ty known as the "Cour~hause -
Square" to ~he Bu~te Caunty Board o~ ~duca~zon. The ~u~te County
Supe~intenden~ of Schoals shal~ vacate his present offices 1oca~ed
in ~.he old coun~y libxary btxilding and shall relocate to ~he old
county administratian building as soon as ~easibl~ afte~ the '~
remodelin.~ of the old cou~.~Cy admin~strata~on bui~ding. The Butte
Co~.n~y Superintendent o~ Schools shall maintain the special ed~:ca-
~ion and media cex~.ters in their present location.

this resolu~ion tha~ ~he Gounty af Sutte sha11 conduc~ rernodel.in.g,
at the da.rection of the Butte County Board of ~ducata~on., in that
builda.ng ~eferred to as a Coun~y Admin~.stxatio~ Building, which
is situate on that real prope~r~y descxibed in Exhibi~ "A".
T~C i~s anticipated that ~the cos~ o~' remodeling wil~
approximate One Hundred Thousand DoZlars ($I.00,000.00), more or
~.ess. It i.s fur~her agreed by al1 of the parties s~gnatory to
this resolutian that the Bu~~e Caunty Board of Education and the
Su~t~ County Superintendent of Schools shall rei~rnbu~se th~ :
County a~ Bu~te fro~n the Cot~rzty School. Service Fund fox the
remode~i.n.g, at the rate of '~wen.ty Percent (20%) of the cost pe~
year in order tha~ the county will be reimbu~sed for ~he cost af

10. At the present time the Bu~~e County S~per~ntendent
af Schools o~~ice has ce~tain e~uxpment, supp~ies, and ~~rni~ure
that was purchased from county general funds. I~ ~s agreed ~ha~
upan the effective date o~ this resolution a11 such p~operty sha~l
revert to the Butte County Superintend~~~ of Schools.
