CERTRIN COURT FILING FEES
WHEREAS, the Co~nty Clerk is constitutionally empowered to serve as
ex-officio clerk of the superior court; and
WH~REAS, the County C7erk 9s mandated to collect the fees specified
by 1aw when filing and processing the court's documents; and
WHEREAS, the current filing fee schedule pertaining to civil, probate
and famiTy 1aw actio~s is inadequate to maintain an acceptable level of servfee
for citizens seeking judicia7 redress; and
WHEREAS, it has been determined that taxpayers have been subsidiz~ng
the County Clerk's budget to pay for the costs of filing and process~ng civil,
probate and domestic re7ations actions; and '
WNEREAS, many fees have not been changed for years (1947-1975) and
f~creases which hava not kept pace with the continua7 rise in ~he cost of
Ziving; and
WHEREAS, loca7 govern~ent will comply with legal mandates but also
requires adequate revenues in order to carry out those mandates,
N~W, THEREFORE, 8E TT RESOLVED, that the Board o~ Supervisors, County
of Butte, supports the passage of AB 425 introduced by AssembZyman Thurman,
Senator Alquist and Senator Johnson and others, which wouZd ~ncrease certain
superior court filing fees and allow the County ta coilect the proper revenue
from which to fund these court services.
NOW, THEREFORE, SE I7 F~RTH~R RESOLVED, that copies of this resolution
be forwarded to Assemblyman Thurman, Assemblyman Chappie, Senator Alquist and
5enator Johnson.

20th day of March, 1979, by the fo3lowing vote:
