AND NON-EXCLUSIVE FRANCHZSES FOR THE
O~ERATION OF CABZE TELEVISiON SYSTEMS
WITHIN THE COUNTY OF B~TTE
WHEREAS, this Soard has previously issued business l~censes
and non-exclusive ~ranchises for the operation of various cable
television antenna systems within the unincorporated areas of the
County of Butte; and
WHEREAS, the aforementioned business licenses and non-
exclusive franchises regulate ~he rates which the various cable
te~evis~on antenna systems may charge the consumers for their
services; and
WHElZEAS, this Board has derermined that the regulation of
rates charged to the consumers is not in the public interes~; and
WHEREAS, said business Iicenses and non-exclusive franchises
also contain provisions to tne effect that service wi11 be supplied
throughout various franchise areas on demand and that this Board
determines that such a provision is impractical in the unincorporated
areas of the County of Butte.
NOW, THEREFOI2E, BE IT RESOLVED by the B~tte Coun~y Board of
Sugervisors as follows:
l. That all business licenses and al1 non-exclusive
£ranchises previously granted by this Board are hereby amended by
deleting therefrom any regulation of rates to be charged the con-
sumers of such services.
2. That all provisions in said business licenses and non-
exclusive franchises for the oper.ation of cable television antenna
services is hereby amended by deleting any requirement as to the
giving of services throughout any franchise area on demand.

3. That in the so7.e discretion of this Board, the County.
of Butte may, at any time in the tu~ure, reimpose the regulation
of rates as well as the reinstatement of the requiremen.t as to
giving services throughout any franchise area upan demand. The
franchises or business license £ees as provided in each company's
license or franchise agreement shall continue to be paid at the
rate stated therein and sha11 include the percentage so stated as
to all of the operations and shall be the percentage of thei.z gzoss
income for operations within the County of Butte.
4. This Resoluti.on sha11 not be e~feetive as to any cable
television oparator withi.n the County of Butte unless and until
they have executed a copy of this Resolution and returned it to the
Clerk of the B~tte County Board of Supervisors. Execution by the
cable television company involved wi11 constitute acceptance of
the terms and conditions of this Resalutian.
