Agency Formation Commission designated this Board of Supervi.sors as the conducting authority and directed the Board of Supervisors ~o initiate reorganization proceedings, and WHII?.~AS, on July Z0, 1979 the Board of Supex~v.i.sors adopted resolution 79-1.23 initiating reorganization proceedings and calling for a public hearing nn July 3Y, 7-979 at 8:00 p.m. in Paradi.se, and YJfiERE~S~ on July 31, 1979 a~blic hearing was held and public comments were taken. NOW~ THEIiEFnItE~ BE IT RESOLVED ANll ORAERED b~r the Butte County Board of Supervisors as follows: J.. An election is called and ordered to be held on Tuesday, November 6, 19'79 in ~he area described, for the purposes of determining whether it should be reorgar-zzed and for the purpose of electing counci].men. 2. The area w.i.thin which the election sha11 be he1.d is described in Exhibit A and attached to this resolu~.ion and incorporated in it by this reference. 3• Notice sha].1. be given of the electzon to be held in the proposed town. The notice shall accurately describe the bourzdary of ~.he proposed town as fixed and established by the Board, and the date o~ the e3ection. The notice shall requa.re the voters to cast ballots contai.ziing the words "for reorganization" and "against reorganizationf' and the names of the persons ~o be voted for to fill the offices of town counci]man. 4. The notice shall be published pursnant to Section b066 of the Government Code in a newspaper af general circulation printed and published within ~he proposed boundaries. 5• The elec~ion sha11 be conducted and officers nominated pursu.ant to the provisions of the Election Code concerning distriet and municipal electzons and in addition the preparation of an impar~ial analysis of the proposed ineorporation, the filir~ o.f written arguments for or against the proposed incarporation, and t~.e preparation and ma:i.ling of ballot pamphlets, sha11 conform with Government Code Section 35060 through 35071. The Paradise Fire Protection District and Gounty Service Areas No. 13, 3~, 1+9, 61~ and 65 sha~.7~ be dissolved by ttv.s reorganization and successor district shall be the Town of Paradise. 7. The name of the newly incorpora~ed area shal.l be the Tor~m of Paradise (an incnrporated municipality). S. The Tawn of Paradise sha11 be organized as a general law city with a city manager type of government having the folZowing structure: a five member council e3ected at large, an appoin~ed municipal clerk and m~u3icipal treasurer, and six departments inc~.uding administra~ion, finanee, attorney, community deve3opment, public works, and police. 9. The Paxadise Fti.re Protection District and Butte ~ounty shall continue to provide servzces in the event of a successful reorganizatian and incorporation until July 1, 1980. These services shall include the extended count~ services associated wi-~h the varions coun~ty service areas whieh are within the incorporated area. The speca.al election called on the question of the reorgar,ization in Paradise sha~l appear on the ballot as follows: Shall ~he order adopted on July 31, 1979 by the ~g Board of Superva.sors of the County of Butte Reorganization ordering a reorganization affecting the Paradise Fire Protec~ion Dis-~z~.ct and County Service Areas No. 13, 3$, 1+9, 61~, 65 and ordering the incorporation of the Town of Paradise under the AGAINST ' provisions of ~he Municipal Organization Act of 1977 be confirmed.
