HomeMy WebLinkAbout79-164RESOLUTION OF INTENTION TO DEC~ARE ABANDONMENT OF ~URiiAM CEMETERY AND TO DEDICATE IT AS A PIONEER MEMORIAL PARK WHEREAS, there is within the boundaries of the County of Butte a cemetery known. as the "Durham Cemetery", which cemetery is described in Exhibit "A", and was historically utilized to inter the people in the Durham area; and C~~1t~AS, i~ appears that said cemetery is not, at the present time, being utilized to inter human dead bodies and there has not been ten bodies interred in such cemetery ~or a period in excess of five years from this date; and WH~REAS, many citizens of the Durham area and of Butte County have relatives who are buried in the Durham Cemetery, and recent activities both in and surrounding sa~d cemeterq have caused both desecration and obliteration to the graves and markers, which has created emotional distress and discom~ozt for many; and WHEREAS, it appears that said cemetery, in its present condi~ion, endangers the health, safety and welfare of the people; NOW, THEIZ£FORE, BE IT RESOLV~D tha~ ~his Board intends to declare the Durha~ Cemetery described zn Exhibir "A" abandoned as i a place of future interment except as provided for in Health and Sa~e~y Code §8825, to wit, ".... shail permit intermenr in the cemetery of any person who is an owner of a plot in the cemetery on the date of adoption of the'resolu- tion of who otherwise has a right of interment in the cemetery which is vested on such date."
