RESOLUTIOIQ REQUESTING A CIiANGE IN P~NAL COD~
§ 905 . 5 TO ALLOW GRA1Vb JURIES TO SERVE', DiJRING
A CALEPdDAR YEAR OF THE COUNTY
WHEREAS, this Board 'nas reviewed over a'number o~' years
the problems of grand juries serving during a fiscal year of the
county; and ~;
WHEREAS, the requirement that a grand juxy be impan.eled
and serve during .the fiscal year of the eounty commenced in 1973
by virtue of Chapter 428 of the Laws of 1973; and'
WHEREAS, this Board believes that it is, in the public
benefit and welfare that grand juries serve during a calendar year.
iQOW, THEREFORE, BE IT RESOLVED as follows:
1. That this Board resgectfully requests that Penal Code
§905.5 be amended to read as ~ollows: '
"The grand jury sha1~. be impane7.ed in January
of each year."
2. That copies of this resolution be sent to ~the Honorable
Ray 3ohnson, State Senator, the Honorable Stan Statham, Assemblyman,
_ and the Honorable Gene Chappie, Assemblyman. '
