HomeMy WebLinkAbout79-183Resolufion No. ~9-1 RESOLUTION ESTABLTSHTN~ A SERVZCE CHARGE FOR COUNTY SERVICE ,A~tEA #59 PARK VTSTA STREETLIGHTING WHEREAS, on August 1Q, 1979, the Butte County Board of Supervisors set a date o~' public hearing to consider establishing a per parcel service chaxge in order to ~znance the projected expenses o£ County Service Area No. 59 and WHFREAS, on Septembex 7, 1979, a report was filed with the C~er1c of ~he Board of Supervisors which p~ojected a budget of ~g07 in fiscal year 1979-80 and suggested that Ghis cost be spread evenly among the 70 ta~c paying parcels within this County Service Area and WHEREAS~ on September 11, 1979, a scheduled pub~.ic kzearin.g was he7.d and no one appeared to protes~ ~Ehe establishment of this per parcel serrrice charge. ' NOW, THEREFORE, BE IT RESOLVED AND ORD~RED by the Butte Coun~y Board of 8upervisors as fo].lows: In accordance with the provisions of the Butte County Code, Sections 21-85 ~hz'ough 21--90 a per parcel service chaxge shal~ be levied against all ~he parcels within Cov.nty Service Area No. 59' as described in the repor~ filed with the C1erk o~' the Board of Supervzsoxs on Jul.y 26, ~979. Each parcel sha11 be assessed a flat per parcel service charge of ~'l1.53 in order to finance the budget for this County Searvice Area. The service performed by this County Service Area is streetlighting. Said charges sha11 appear as a separate item on the tax bill and sha11 be collected a~ the same time and in the same manner as ordinary County ad valorem taxes are collected and sha11 be subject ~o the same penalties and the same procedure and sale in the case of delinquency as provided for such. taxes. A11 laws applicable to the levy, collection and enforcement o~ County ad valorem taxes shall be applicable ~o such charge~ except that if the real property ~o which such charge relates has been transferred or conveyed to a bonafzde purchasex for value~ or if a lien of a bonafide encumbrancez~ for value has been created and a~-~ached thereon~ prior to the date on which the first ins~allment o~ such taxes would become delinquent, then the charge conf'zrmed pursuant to this resolution sha11 not result in a~ien against said real propexty but instead shall be transferred to ~he unsecured roll for collection.
