FOR PRII'ARATION OF E~NVZRONMENTAL Il`~ACT REPORTS BY
THE ENVII~ONME[~TAT, REVIEW DIRECTOR
' ~REAS, the Board of Superv~.sors adopted Resolution No.
76-191 initial~.y establishin.g filing fees for enviroa.ime~ta~ review; and
' WHEREAS, the Board of Supervisors adopted ResoZution No. '77-5,
' wh~ch es~ablished procedures for the determination of costs fo~ p~epara-
' ~ion af ex~vironmental impact reports; and
~'~S, the Board of Supervisors adopted. Reso~.u~ion Nos.
'~7--63, 78-89, and 78-115, which resolutions am.er~ded the schedule o~
filing fees and procedures ~or determination of costs; and
, WH~REAS, it is desirable to increase the level of services
: of the Enva.ronm.er~tal Review bepartment and to shorten the time required
~or envzronmental review; and
1n~L FAS, in orde~ to provide for such increased services and
ta compensate for cost increases due to inflation, it is necessary to
' establish new f ees and up-date the procedure for determ.inating costs.
NOW, THEREFORE BE IT RE,SOZVFI} b~ the Board o~ Supervisors
of the Count~ of Butte, State o~ Califoxnia, '~hat e~'~ective
iVovember 1, ~g79:
1. Resolutioxzs No. 76-191, '77--5, 77--63, 78--89, and 78-~115,
' axe rescinded. ~
2. The next to last paragraph of Resolution No. ']']-16} is
amended to read as ~ollows:
"No dis~rict shall be charged in excess of $250.00
fox the cost o~ an iz~itial study prepared by the
Butte Count~ Environmental Review Director without
the express authorizati.on o~ -~he specia~ d.a.strict
for whom the initial study is being prepared."
3. The schedule of f~l~ng fees for environmental
review and procedures ~or deterzpi.n.ation of costs for
preparation of environmental impact reports, attached
' he~eto as Exhibit "A" is adopted on behalf of this
Board.

Multiple Projec~
A multiple project is where the same person makes applica-
tions for two or more related projects at ~he same loca~ion, i~ -the
application for each succeeding project is fi~ed within six months
o~ the preceding project. The f ee f or a multiple project sha11 be
computed as the sum of the hi~hest ~roject f ee plus 50 percent of
each additional project f ee.
~Z~.OCIDTTRES FOR DETERMINATION OF COSTS FOR• PREPARATION OF
ENV~R.ONMEN'~A~, TIKPACT R~PORTS
Private and Public Projects: The applicant shall pay al1
costs inc~asred ~or administration and preparation of an environmental
impact report up to and including the filing of all Notices of
Determination rela~ed -~o the pro~ect.
The Envi~onm.en~tal Review Director shall estimate costs
associated with the prepara~ion ~n.d administration of the environmental
impac~ report. Tn preparing the estimate of costs for environmental
impac-~ report preparation and adm.inistration, the Environmental Revzew
Director shall iaclude public hearing attendance, pr~nting costs,
consultant's f ees, i~ any, and any otl~er rel.evant expenses
incurred bp the coun~y. Zn es~timating t}a.e costs of persor~nel time,
the Envi~onmental Review D~.rector shall multiply ~he hourly salary
rate of county employees involved in the preparation and administratioz~
of the environmental impact report by a facto~ o~ ~wo.
The app~~caz~.t shall depas~t the amouxzt estimated b~ the
Environmenta~ Review Director for p~eparation and adm~nistration
o~ the envixonmental i~pact report wzth Butte County.
If the actual preparation a.nd administration costs are less
than the amount deposited by tla.e applicant, the remaining amowa.t
of money ehall be returned. T~' the costs of preparation are greater
than the estimate, the applicant shall pay the additional am.ount.
In d.etermi~aing actual preparation and admi.nistration costs, personnel
costs sha11 be determined in the same manner b~ the Environmental
Review Director, as when estimating costs of personnel time.
In the case of subdivisions, when an environmental impact
report is required, any amount of the fee deposited.for initial review
not ~et expen.ded, shall be credited towards the preparation and
adminis~ration of the envi~or~mental impact report. If an environmental
impact report is not ~equired, or if the costs of the preparation
and adminis-~ra~ion o~ the environmenta~ impact report are less than
the filing fee collected, the app7.icant sha11 be entitled to a re~und
of that por~ion of the filing f ee which exceeds the actual costs of
preparation and admi.nistration of the environmental im.pact report, and/or
initial review. Such.refund shall only be processed when the amoun-~
of such refund exceed"s $25.00.
