located approx~mat~~y as indic~ted oa ~he print o~ Ra~~road's
Sacram~nta U~~~s~an Dxaw~ng Q-ZT~B revised June 1, 1978, a~tached
and made a part hereof. Insta~Iation o~ and a~l materials ~ar sa~d
s~gnals s~a.ll be ~n accordance with Rai~road's usua~ s~andardsa
Grantee agrees ~o re~m~urse Rai~road for on~ hundred percent
(100~0) of a~l cost and expense incurred by Rai~road in ~urn~shing
~a~eria~s and per~ormi~g ~he work speci~iEd in this Section 4.
Railroad shal~ s~bm~t to Gran~ee a bill ~ar eighty percen~
($0~) a~ Gra~~ee~s share o~ the es~imated cost upon ~omple~~on o~
~ark contemp~ated, which bill Grant~e agre~s to promptlq pay. Shou~d
the actual cost prove~ upo~ camp~etion a~ audit, to be more ox ~ess
tha~ such estimated cost, ~he di~~erence shal~ be p~a~p~Iy paid by
Grantee, ar refunded by Railroad, as ~he case ~ay be.
5. Gran~ee, a~ i~s expe~se, shall ~ur~ish.and ~nstall paving
thraugh ~he crossing ar.ea and furn~sh an~ insta~l and therea~~er
main~a~n a~~ pav~~g on ~he approaches to the crassing area, toge~her
wi~h a~~ curbs, gutters and o~her s~ree~ ~acilities.
6, A~ter ~nstalla~ion o~ sa~d si~~a~s has been co~ple~ed, Rail-
road sha1Z main~a~n ~a~e so ~ang as they re~a.in in;place. Gran~~e
sha1~ pay one hundred percent (~0~~) a~ ~he co~t af such maintenance.
?, Gran~ee shall cons~ruc~ and ~aintain such fences, barrica~es
and s~gns as roay be nece~sax•y to preven~ the pub~ic ~ro~ using ~he
roadway with ~o~a~i~ed vehic~e5 a~her than motoriz~d w~ee~ chairs
opera.ted by physically handicapped persans.
~. Zn the event Railroad is unable ~v co~plete the ~o~k to be
perfarmed by Ra.ilraa~d hereunde~ cancurrently with Gran~ee's roadway
cons~ructian, Gran~ee, at its e~pense, shal~ ~urnis~, p~ap~r~y~~n~
stall and maintain such ba~r~cad~s, warning 1~ghts or other 3mp~e-
men~s ar dev~ces as are necessary and appropr~ate for pedestrxan

15, Shnu~d Grantee at any ~ime abandon t~e use of sa~d p~operty,
or an~ part thereo~, or ~a~l ~o use ~he same ~ar said purpose ~or a
con~inuous period o~ one (~) year, ~he r~ghts granted shali cease to
the e~~ent of ~he use so abandoned ar discantinued, and Ra~~road shall
a~ o~ce h~ve ~he right, in addi~ion to but na~ in qual~~icat~on o~ the
rights he~einabove reserved, to xesume exclus~ve possessian o~ sa~d
