of Butte hereby approves the attached above-entitled agreement between
the County of Butte and Staee of California (Depart-~nent of Eorestry)
and hereby aathorizes the Chairman o£ this Board to execute same on
behalf of the County o£ Butte.

except upon those lands wherein ather agencies of gavernn-ent have responsibilfty
for the same ar similar fire protecta.an services.
The Skate wi1~ be allowed flexibi~.~ty in the ass~.gnment of avail.able
personne~. and equipmen~ in order to p~ovide the fize protection serv~ces as agreed
upon herein.
B. Ttie State shal.~ assume na responsibility ~nr ~ire prevention or suppression
on lands under the ,jurisdi.etion o~ the United States, except unde~ such car~di.tions
as may be separately agreed upon by the State; or lands within the corpflrate l~.mits
of C~.t$e5~ exc~pt under suci~ condit3.ons as may be separately agreed upon by the
State and such C~.~~es, or the State and ~.oca3. Agency. .

A, T}~e Loca1 Ager~cy has appropria~ed a s~ of money to provide fire protec~ior~
services wa.thin Local Agency's territorial area of responsibi~ity for the period
trom Ju1 J~ 1 79 ~d .7une 34 1 of the f~.scal year
indi.c~~ed abave and that the sum of $ 1 41 06 so appxopri~ted is
budgeted ~ar expenditures as set for~h in the a~tached Schedule(s) A.
The 5~ate shall ~ake a cl.aim for the cost o~ the services to be rendered
during each o~ the fo7.~.owing periods: (1) 3u1y 1 thraugh December 31; (2) January
1 tl~-rough March 31; and (3) April 1 through 3une 30, the claian £or the period (1~,
,7ul.y 1 throcigh December 3~., sna11 be su3nnitted. by State ~ar actua3. expenses to ~.ocal
Agency no earliar than ,~anuax-y ~. The c7.aim for ~he periad (2 ), 3'anuary 1 t~trough

A final claim wi11 be made by S~ate for actual services rend~red by State covering the
period {3), Agri~ 1 through June 30, giving cred~t for advance payment previa~sly
received by State from Laca~ Agency. Tf the advance payment recexved by State ~rom
~acal Agency ~or the estimated costs exceeds the actua~ clai~ for the period (3), April
1 ehraugh June 3U, a ra£und wili be made by State and acca~pany the final claim. TI~e
State wil~ be allawe~ reasonable f~ex~bility in ~he assigrunent of ava~~able ~~~54~~~~
and equipment in order to prnvide the fire prevention and suppressian sexvice as agreed
upon herein. Any cost to the ~ocaZ Agency for such service shall ~ot exceed the Ca~a~
budgeted cast set ~orth i~ Schedule A.
B. Any change o~ the salaries or expenses set forth in said Schedu~e A made
necessa~y by ac~ian af the Legis~ature or any ather public agency with authority
to direct changes in the l~vels o~ salaries or expenses shal~ be paid from the funds
represented therein ar as sa~d Schedule is a~ended. Thexe sha~l b~ na obligation on
the part of the Local Agency to expend or agpropriate any sum xn excess o£ the tota~
of Schedu~e(s) A whzc~ exceed the appropria~ions of the i~ocal Agency £or the purposes
of t~s ~lgreemen~. ~~, within 30 days after aot~.ce in w~riting from the State ta the
Local Agency that the :ctual cost af main~aining the services speci~~ed in Schedule A
as a result o£ ~egis~ative nr otiher action wi.Il exceed the tota~ ar~iaunt spec~fied
tharein and the Lncal Agency has failed or refuses to make available ~he necessary

If Laca2 Agencq desires to add f~nds t~o the tatal inc~.uded herein to cover the cost
of increased salaries or ser~vices, such increase sha~l be accomp7.ished by an Amandu~nt
to ~his ~greemen~ approved by the parties hereto.

The Local A„ency shall be insured agait~st Torts arisf.ng out of or oecvrring in
the perforr~ance af this Agreement and wz13. furnish, at na cosr ta the State, evidence
o~' liability insurance i.n a torm satis~ac[ory Co SCate, cantai.ni.ng liabi.lity ~.inits
o~ no less than $500,00~.00. Said evidence of insurance mus~ contain the fol3.owing
provi.sions:
(1) That the pol3.cy names as additiona~. ~.ns~red, the State of Ca~~.faznfa act~ng
th~augh i~s Departmeat o~ Forestry, its 0£ffcers, Agen~s, 5ervants, and £mp~.oyees;
(2) That the Stata shall have no responsibility for khe payment of premi.u~s,
asses5ments, or any other cast ar expense on accaunt of the issuance of such policy;
and
{3) That the insurer wiJ.~. not cancel the pa~.~cy ar po}.~c~es invv~ved wi.thout
30 days pr~o~ w~itten notice to the State of Ca~ifornia Department of Forestry,

As pxnvided in Sectip~ 13009 af ~he Health and Safety Cade, tiha 5tate may br~ng
action for ca~lection of suppression cosrs of any fire suppressed on Sta~e respansi-
bility lands during th~ t~x~ af th~s Agreement. When using equip~ent and personn~l
under the tez-ms of tl~is Agreement, the State may, on ~equest of ~he ~ocal Agency,
bring action ~ar co~lection of casts borne by the ~cal Agency in whic~ case the ~oca~
,Agency appa~nts and designates tne 5~ate as ~ts agent in said collection proceedings.
~n tne event of recovery, the State wil~ apportion to the ~ncal Agency its pra-rata
p~opor~ion o£ xecavery, less casts, including 1ega1 fees.

Hea~th and Safe~y Code, the State may, on request of the ~ocal Agencq, demand payment
af charges a~d seek reimbursement af ~ocal Agency costs fdr person~el as tunded herein,
u~der authority given by Section ~3051 and 13054, Health and Sa~ety Code. The State,
~n seeking said reimbur,e~ent wi11 represent the ~oca~ Agency i~ ~o~lorain~ the pracedures
set for~h in Sect~on Z3052, Health and Sa~ety Code. ,~iy recovery, af ~oca~ Agency costs,

All persona~ proper~y provided by the Local Age~cy and by the Sta~e £or th~
purpose ot providing fire pxatec~ion un~~r the ter~s of this A~reement shall be marked
and accounted ~or by the Stat~ For~st OEficer in charge in such a manner as ta conform
to ~he regu~at~ons es~ablished by the part3es ~ar the se~regation, care, and use of
~he respec~iue prop~rtq of each.

The "arganiza~ion" to be pravided by 5tate, and the est unatel cost of services
ta be perfor~ed by ~aid "arganizatian", and al~ related cos~s, are set for~h in
Schedule(s) A.
A. A~~ services and dixectly related expenses provided by the State for th~ bene~i~
o~ the Local Agancy, b~tih year long and seasonal, including: State equipment, personnel
and buildings; the Qpera~ion and maintenance of equipa~ent pravided by khe ~ocal ,Agency;'
volunteer or o~hex ~aca1 fire forces and a~i related expenses borne direct~y by tihe
State and to be reYmbursed bq the Zocal Agency, sha~l be shown separately a~d the
total o~ a~l services and relaxed casts shali no~ exceed ~he amount shown in SecCion
~~I, afareEnent~oned. ~n the case a~ services prov~ded under 5ect~on 4143 and 4i44,
Public Reso~rces Cp~E~ a separate Schedule A, marked "A-4~44", shali be used to show
the cost apportionment ~o be charged to ~he ~ocal Agency £or the use of State equipment,
personnel and bu~ld~ngs dvring the non-~~re sesson.

B. Certain State fire s~ations, and/or ~hase State furnishe~ fire pratection
activit~es (marked "W' on the attached Schedule A) wil~ be provided on a year round
bas~s. Laca~ Agency wri.11 re~mburse State ~or all such "W" stat~ons and/or services
fu~nished during ~he "periad cavered" indicated on th~ afore~entioned Schedule A,
State does no~ guarantee that the level of service to be provided autside ~he
"peri.od cov'e~ed" wi1.3 always be the same as that to be provided duxing the "period
covered", and, a.n o~der to pro~ride an e£fective 5ta~e-wide fire protection service,
S"tate reserves ti~e right to send, a~ any time, personr~el and/or equipment from an.y
"W" station to any other location as may be deemed necessary by State.
~C. T].ie Local Agency agrees to pay the actual cost a~ sa~aries, p~us ret~.rement
and a1~. A~~E~ employee bene~its, for those personnel employed in accordance with Schedule(s)
A, except when "contract rates" are indicated, the rate shall he based on an average
salary p~us a].1 benefits. "Contract rates" means an alI-in,c}~usive ra~e covering taCal
costs, per specified gositian, to the State for praviding 24-hour fire protection
coverage duri.ng the "periad covered" es~ablished 3.n Schedule A.
D. For fire ~xotection services provid~d under Schedule A-47.44, the distx~i:burion
of costs sha~~ camply wi~.h Section ~~4~, Publ~.c Reso~rces Code.
Eo Reimbursement ~o the State may be paid from any funds budgeted wi~hout regard
xa categary and, if necessary, fram any contingency item.
F. Records, baoks, e~.c., shall be made avai~.able for audi.t by the Locai Agency
at rhe ~ffice of the Directo~ of Forestry. For any ser~vices performed directly by
t}~e State or pracured by ~he 5tate ~or Che Local Agency, as contempl.ated under
Schedule A.

"i~acal Agency-awned vehicles", as herein def ined, shal~ xnean any vehicles listed
in said Schedu].es A and C, any ather vehicles made ava3.lable by ~he ~ocal Agencq, but
no~ including, State-owned vei~icles, ~or rha per~armance of fire protectian services
under this Agreement. A"5taxe-owned vehicle!° is any vehicie owned and reg~.stiered in
the name af the State of Californ~a.
A. In the cas~ af State-awned veh3.cles operated on behal€ a£ ~he Local Agency
and listed in Schedule p, ~he agreed cost of operation shall incJ.ude al.l costs pertain-
ing ta running, xepairing, rep~acing, and insuxing ~the aforesaid vehicles.
A. In the case of tihe Local Agency-owned vel~icles aperated by the State on behalf
of the Local Agency £or the agreed CQSCS as set~ forth in Schedu~.a A:
{1) The Sta~e Sha1~.:
a. Provide gasa~ine, oi.l, lubrication, batteries, tires, and tubes;
b. ltepair, exchange or replace, when necessary, motars, hoses, pumps,
spot~.igh~s, s~rens, fire ext~.nguishers, and a~1 other accessories
affix~:d to or supplied wi.th the aforesaid rrehic~.es when the l.attier
were accepted by the S~ate fox operatian under Schedule A,; exceptir~
fac~i7.ities or accessories not cos~mion to the use of the State, and
radio ins~allations flriginally provided by the Local Agency. A~1
such equigznent provided and installed by the State shall becnme the

property of ~he Loca~ L~gency and the reglaced equipment remdved

c. Make ~uch reasonab~e repairs to said vehicles (but~not including
paintingj as may be necessary to keep ~he vehic~es in aperat~ng
condition; provided, however, that the State may cease to m~ke
~ur~her repairs an any vehicla ~hen the State determines that t~e
r~pair C05~5 duxing the periad of ~~is Agreement sha~l axceed, or
hava exceeded, tha ~ar.ket value of the vehicle. Zn t~e event the
S~a~e deter~ines that a veh~c~e is not fit ~or further use because
af obsolescence or a wreck, ~he State shall not he required ta
repair the vehicle or maintain i~ in use. Upon such de~erminat~an,
the Sta~e shall immediately so ~a~ify the Lacal l~ency, and the Lacal
,Agency sha~l have the option o~ replacing sai~ vehicie or S~ate shall
d~scontxnue the particular service re~uired as a resu~t of ~ts pxevious
existence.
(2) T}-a Lacal Agency Sha~l:
a. Acquire, iicense, and make available the said vehxcles.
b. Reirnburse the State at the agreed cost for the opezation o~ said
vehic~es.
C. In the case of I~ocal Agency oraned vEhicJ.es pxovided by I,ocaI. Ageney, for
p~rformance as cantempl.ated hereunder, bu~ not included 3n 5chedule A;
(~) '~he State shall coz~~oxm to policies of the Loca1 1~gency in operation,
use, care and maintenance of said ve~iicles.
(2) The ~.ocal Agency shall assume ~u~l resgonsibili~y for a11 costs associated
wirh the acquisition, operation, use, care, mai.n~.er2ance and replacement
of said vehi,cles.
D. ~or a11 Loca1 Agency owned vehicles operated ar used by emplayees of ehe State,
under the terms of this AgrE~Fii~ilts the Local Agency assumes £u7.1 xespansibility for

When a Loca1 A,gency et~npl.oyee, under ~he sU~ervision o~ the State ~orest nfficer,
operates a S~ate-owned automoeiv~: veh.i.cle as a paxt of his duties and in connection witi~
fixe protection services, he w~i}.1 be deemed an agent of the Stiate for acts or om5_,sions
in the use o£ such vehicJ.e.
