HomeMy WebLinkAbout79-241RES~LUTION PERTAINING TO AND IN OPPOSITION QF THE GOVERNOR'S ODD-~VEN GASOLZNE ALLOCATION PLAN WHEREAS, this Soard is in rece~pt of the Governor's proclamation and order pertaining to odd-even gasoline al~ocations; and WHEREAS, the proclamation only specifically identifies a state of emergency in 14 counties and a part of another, yet further states the "program" shall apply to a11 remaining counties on December 3, 1979; and WHEREAS, this Board is presently faced with the financing problems result- ing from Chapter 282, Statutes of 1979; and WHEREAS, this Soard presently has before it monumental budgetary problems relaCive to the financzng o€ law enforcement functions which axe necessarq for Che protection of the health, welfare and.safety of the c~tizens of Butte Countp; and WHEREAS, there are simply no financial resources available to actively police the many hundxeds of gasoline stations in this area; and WHEREAS, this Board does request that the public mak2 everq effort possible to conserve energy. NOW, THSREFORE, BE zT RESOLVED as follows: I. Assuming arguendo thaC the proclamaCion and accompanying regulations eEfectively, consCitutionally and statutorily establishes regulations with the force o£ law in this counCy, this Board respectfu~ly xequests that the Governor reconsider his order at this,time and only declare odd-even gasoline allocations for those counties requesting it. 2. That although this Board is fully cognizant that the actual enforcement of the Governor's order is the Sheriff's and District Attor~eyTs responsibility, this Boazd simply does not have Che financial resources availab~e to provide these departments with adequate staff to police Che hundreds of fiiling sCations in the County. Thus, we would anCicipate that enforcemen[ of Che order will be dependent on the voluntary acceptance by the public. -, -2- 3. That all County departments are instructed to refer inquiries or requests for in£ormation on the order to the Energy Resources Commission, 1111 Howe Avenue, Sacramento, Calif. 95825 (9I6) 492-3690. 4. Tha~ a copy of this reso~ution be sent to the Honorable Edmund G, Brown, Jr., Governor of the State of California, the Honorable Ray Johnson, State Senatar, the Honozable Gene Chappie, Assemblyman, and the Honorable Stan Statham, Assemblyman.
