This matter came on regularly for hearing be~ore the
Board of Supervisors of the County of Butte, State af California,
on Januarv 15 , 19gp, in the Board Chambers, Butte County
.A,dministration Building, Oroville, California, and it appear~ng ~o
said Board ~ha~ a Notice of Time and 1'lace of Hearing of said
Abandonment was duly and regularly given as required by 1aw, and
testimony and evidence, both oxal and documentax'y, having been
produced at said hea~in.g, from which said Board now finds that the
hereinafter described draa~nage easement is unnecessary for present
or prospective public use.
NO~d, THEREFORE, IT IS HEREBY ORDEx~ED as follows:
l. That the publ~.c utili.ty easement situated in the
County of Butte, State of California, as hexeznafter more particularly
described is hereby abandoned.
2. That the description of said drainage easement so
abandoned is si~ua~ed in the County of But~e, S~ate of California,
and more particularly described as follows:
A portion of Section 23, T231~I, R3E, MDM and being
a portion of Paradise Pines ~Init No. Z2 as shown
on that certain map thereof, recorded in P4ap Book
38 at Page 27, Butte County Official Records, more
particularly described as follows:
A strip of land 2.00 feet wide, the southeasterly
line of which is 8.00 feet northwest of and parallel
with. the south.easterly Iine of Lot ~26 of said Unit
No. 12, excepting therefrom the northeasterly 10.00
feet, adjoining the northeasterly boundary of said
Lot 126 and tne southwesterly 20.00 feet, adjoining
the noreheasterly right of way of Bridgeport Circle.
3. That the Clerlc of this Board shall cause a certified ,~

WHEREAS, Article XI~IA o~ the Ca~ifarna.a Consti~u~ion
(ac~ded June 8, i~~s) ~imi~ed ~.ocal agencies ability to levy
praperty taxes and required ~he ~imi~ed praper~y taxes raised
to be a~.located amang variaus local agencies in accordance with
1aw; and
WHEREAS, Chapter 282, Statutes of 1979, as amended by
Chapter ~.16I of the Statutes of 1979 (R~venue and Taxation Code
Sec~ion 99 (b) implem~~.ting provisions of Ar~icl.e XT~zIA o~ the
Consti~ution) requires ~he governing bodies of a11. agencies
whose service areas or service responsibi~.~.t~es would be aJ.~tered
by a change o~ jurisdiction (e.g. ann~xations to ar de-annexa-
tians from cities} to determine ~he amoe~nt of prope~~y tax
revenu~s ~o be exchanged between and arnong such affected agencies;
and
WHEREAS, no su~h jurisd~.c~iona~ change sha~l become ;

ef~ecti.ve unt~l each county arzd ci~y inc7.uded in such negat~a~io~. ~

WHEREAS, representatives of Bu~~e Coun~y and its cit~es
of Biggs, Chica, Gridley, Oroville and Parad~se ha~re met and
negotiated; and
WHEREAS, Butte Cfl~nty and each of i~s citi~s recognize
~he signi~ican~t ~inan.cial CI1.~~1CUZ~l.ES and thei~ impacts upon
~.ocal government's abi~.~,ty to provide 5ervices to i.ts citizens;
and
