WHEREAS, tl~e provisions of ttze Revenue and Taxation. Code
require agreem~nt between the County of Butte and its cities
concerning annexations;
NOW, THEREFORE, SE IT RESOLVED by this Board that the
Agreement attached hereto as Exhibit "A";is incorporated herein
as if set forth in full and is tiereby approved and executed by
the County of Butte.

exchange. The agreemen~ sha11 remain i.n fu~.l force and e~fect
~or par~ies not involv~d in such ~~rnnination.
4. zn the case a~ a jurisdictional change, which would
~ ma~erially affect the ~on-property tax revenues of either Butte
~I County ox any af its citi~s so as ~o significantly i.Fapair its ;
~, abil.ity to provide ~or the publ~c hea~.th and safety of ~.~s citi-
ze~s, such ~xchange af property taxes sha11 be considezed outside
~h~ scape of thxs agreem~n~ an.d shall be subject to separate
nego~Ciati.ons. The party hereto who would ~.ose xevenue sha11 be

~ 2 lose revenue shal~ be ~he par~y making the determinatio~ as to

Chapter 1161 of the Statutes of 1979 (Revenue and Taxat2on Code
Sectior~ 99(b) implementing provisions of Arti.cle XIIIA of ~h~

whose serv2ce areas or service responsibilities would be al~ered

tions from cities) to determine the amount of property ~ax

Coun~y or any of its cities so as to s~gnif~cantly impair its
ability to provide for the public heal~h a~d safety of its
citizens, such exchange of praperty ta~es shall be considexed
au~s~de the scope of this agreement and shall be subject ~o
separate negot~a~ions. The party here~a who would los~ revenue
sha~~ be subjec~ to sepa~ate negotia~ians. The party hereto who
wou~d lase revenue sha~l be the party rnaking the dete~mina~ion
as to whether or nat the j.urisdictional change "mate~ial~y affects"
~ ~~s non-property ~ax revenues.
