NOW, THEREFORE, BE IT RESOLVED, ~he Board of Supervisors of the County of Butte hereby amends section 2.57 of the Personnel Rules by de~eting the section in its entirety. NOW, BE IT FURTHER RESOLVED, that section 10.1 of the personnel rules is amended to read as fo7lows: ]0.1 SAFETY PROGRAM a. PURPOSE. The purpose of the Safety Program is ta safeguard the 7ives of county employees by providing a safe work environment and require tha~ employees follow safe work methods. Therefore, it shall be the policy of the County of Butte that each county department establish and maintain a safety and accident prevention program. Accident prevention shall be the direct responsibility of each official (whether elected or appointed), appointing authority, supervisor, foreman and employee of th~s county. Each appointing authority shall be responsible for motivatfng employees to practice safe work habits. Each employee fs responsible for compliance with safety regulations and procedures. b. OBJECTIVE. The Butte County Safety Program is established to eliminate and prevent accidents. Accidents can be elimfnated and prevented by stopping the unsafe acts of individuals and remaving unsafe working conditions. The success of this program can be achieved by the complete understand~ng for its need and the positive support for its impTementat~on by a11 county officials, supervisors and employees. c. PLAN. Tn order to fulfilT the program objective, each department sha11 initiate a safety program. d. RESPONSIBILITIES. 1. The Personnel Direc~or shall: {a) Estab~ish and maintain the county accident report and record system for workers' campensation. {b) Act as ~iaison be~ween the county and the comper~sation insurance administrator. 2. A11 e1ected and appoin~ed department officials shall: (a) Implement a safety program ar~d provide the required safety equipment within their department. (b) Submi~ reports of accidents to the Personnel ~irector. (c) Post on bulletin boards or otherwise distribu~e among the employees written safety materia1 as req~aired by law. RESOL~7ION AMENDING SECTIONS 2.57, 10.1 AND 10.5 OF THE BUTTE COUNTY PERSONNEL RULES (d) Take responsible action to assure that employees practice safe working habits and use the provided safety equipment. 3. All employees shall: (a) Practice safe working habits in the discharge of their duties. (b) Comply with all safety ru1es and regu~ations. (c) Promptly report all accidents to their immediate supervisor. (d) Participate in organized safety training programs. NOW, BE IT FURTHER RESOLVED, that section 10.5 of the personnel rules is amended ta read as follows: 10.5 REIMBURSEMENT FOR EMPLOYEE PERSONAL PROPERTY L055 a. The County of Butte shall provide payment of the costs of replacing or repairing property or prostheses of an employee necessari7y worn, used or carried by the empToyee when such items are lost or damaged in the line of duty. Payment of claims under such coverage shall not be appealable under the grievance procedure. b. The County of Butte shall not provide reimbursement for damages to an employee's personal vehicle used on coun~y business. Reimbursement for the use of an emp~oyee's private vehicle on caunty business is provided for in these rules. Such mileage reimbursement includes maintenance, repair and insurance costs. c. Each appoin~ing author~ty shatl approve or deny employee c1aims based on ~he folTowing reimbursement schedule and shall establish procedures to verify c2aims and notify the claimant of the decision: 1. Refmbursement for trades or crafts too1s wi11 be at full compara6le replacement value and shall be limited to those items which appear on a written inventory of tools required by ~he appointfng authority to be supplied by the employee for use in work. For each incident, a deductib1e of ($50) fifty doTlars sha1T be applied to each employee's loss. If sto~en tools are recovered in an undamaged condition and replacement tools have been secured, the employee shall return to the county the rep~acement tools. When the replacement tools are returned to ~he county, the employee shall receive from the county a($50) fifty dollar deductible. If rep~acement tools have nnt been secured, the employee shall return all reimbursement funds received from the county. 2. Reimbursement for personal prostheses such as hearing aids or corrective Tenses, wi1T be at comparable replacement cost of such i~ems damaged beyond repair and the repair cost of items that are repairable. The amount of reimbursement shall not include the cost of fittings or examinat~ons. 3. Jewelry items do not come within the definition of property as set forth in the Government Code. Therefore, no re~mbursement will be made for damaged or lost jeweTry items. Reimbursement for damaged or lost wa~ches is limited to the func~ional value of the watch, not to exceed ($70) seventy dolZars. 4. An employee shall report loss or damage of persona7 property to the appo~nting authority using the county accident report form. Damaged articles for which reimbursement is made may be required to be surrendered to the appointing authori~y, and shail be disposed of in a manner approved by the Purchasing Agent. e. 7he appointing authority sha11 conduct a complete investigation af the incident and damage to include interviewing claimant and any witnesses, inspecting damaged property when applicable, and evaluating the condition of the ar~icle i~ accordance with the reimbursement schedule. Sased on the investigation, the appointing au~hority sha11 in writing approve, deny or modify the c7aim. f. Reimbursement cost authorized under the rules shall be submitted by claim to the Auditor by the appointing authority and charged to the department to which the empioyee was assigned at the time of the loss. -3- g. No reimbursement 9s authorized for loss or damage primarily a~tributable to the claiment's own negligence or to normal wear and tear or for claims filed after 30 days of the ioss or damage ar the employee's knowledge of such ~oss or damage.
