HomeMy WebLinkAbout80-044W~IEREAS, the County of Butte has previously prescribed certain terms and conditions for the business license and non- exclusive franchise granted Nor-Ca1 Cablevision, inc., for opera- tion withzn the unincorporated areas of the County of Sutte; and WHEREAS, certain portions of ~he present license and non-exc~usive franchise agreement are no longer operable. NOW, THEREFORE, BE IT RESOLVED by the Butte County Board of Supervisors: 1. That the rules, regulations and conditi.ons of the business license and the non-exclusi~cre franchise presently held by Nor-Cal Cablevision, Tnc., is hereby amended as follows: Definition of gross receipts. Gross Annual Receipts. Any and a1i compensa~ion and other consideration in any form whatever and any conCribution, grant or subsidy received by a grantee, directly or indirectly ffran subscr~.bers or users, in payment for the transmission of elect~onic signals or the provisions of other services received within the County of Butte, im.cluding, but not limited to, compensation, oth.er consideration, grants or subsidies received directly or indirectly from subscribers or users i.n payment for "pay television" signa~s received withi.n the County; provided that gross annual receipts shall not include the first fifteen dollars ($15.00) of installation fees charged to any indi~vidual subscriber or user, Nor-Cal Cable- visian copyright fees separately billed to sv.b- scribers or users, tees paid to program suppliers, refundable deposits on converters/descramblers RESOLUTION AMENDING THE BUSINESS LICENSE AND NON-EXCLUSIVE FRANCHISE FOR TH~ OPERATION OF NOR-CAL CABLEVISION, INC., WITHIN THE COUNTY 0~ BUTTE provided to subscxzbers or users and, any taxes on the services ~uxnished by the grantee directly on any user ox subscriber by any county, state or other governmental unit collecCed bq Che grantee for such governmental use. 2. That the remainder o~ the terms and conditions set out in the business license and non-exclusive franchise granted to Nor-Cal Cablevision, Inc., shall continue in full force and ef~ect. 2.
